“Atameken” to assess technical rules and regulations

The national chamber of entrepreneurs analyses technical regulations to eliminate barriers for the entrepreneurs.

In the framework of EEA one of the mechanisms of the united market is the establishment of standard requirements to the production in a sphere of technical regulations.

Those requirements on the territory of EEA are being established with technical regulations. Technical regulations of the union mean binding safety requirements to the production of such things as cars, equipment, electrical products, oil and gas, special liquids, convoy, tobacco, toys, furniture, consumer industry production and others.

Nowadays EEA adopted 46 technical regulations, 10 of them were proposed by Kazakhstan. 37 technical regulations already came into force. 9 will be implemented in 2018-2022. 

The obligation of appraisal of the regulating impact does not include Union’s technical regulations accepted before 2016.

In this regard, national chamber of entrepreneurs started its own analysis of accepted technical regulations to find the obstacles for the business.

“There were a lot of cases, when entrepreneurs couldn’t modernize their production and as a result their production was at odds with standard requirements. In such cases, we emergently address to the Eurasian Economic Commission to prolong time limits for transitional provisions of the technical regulations.  For example, we addressed there to prolong time limits for the actions of ecological classes of the vehicles. We prolonged term of applying on low class fuel and utilities that are not subjected to certification etc.”- said “Atameken” vice president, Dana Zhunusova.

Technical regulations must correspond to the level of economic development and to the level of scientific and technical development of the industry. Periodic prolonging of transitional provisions means that the current principle is not always obeyed.  All technical regulations don’t allow to create infrastructure which will guarantee abidance by rules.

Concerning technical regulations on small size vessel, pyrotechnics, explosive liquids and others there is no such infrastructure that will guarantee tests corresponding to technical regulations. The area of influence of the technical regulations is wide and covers all key industries of our country.

That’s why it is important to appraise the real impact of EEA technical regulations to do business.

For example, there is a technical regulation on food products safety that affects the interest of more than 4000 companies, working in the food service industry of Kazakhstan.

It is worth to notify that technical regulations include several related industries.

For example, technical regulation concerning safety of wheeled vehicles, it affects the interests of not only auto manufacturers but also passenger transportation agencies.

Dana Zhunusova explained that in a case of problems with regulations “Atameken” will initiate the implementation of technical regulations for the better business conditions.

“We would like to ask Kazakhstan business community to participate in our joint work. Let’s eliminate barriers for the business!”- she said.

- Survey form aimed at identifying clauses that set out excessive requirements, entrepreneur activity excessive regulating, restrictions or the obstacles for the business.
