Chamber and business of Kostanai region join their forces

It seems that even severe sceptics are beginning to accept the idea that one in business is not a warrior. Businessmen start to realize that it is impossible to overcome legislative barrier on its own, as with joined forces, it is easier to get rid of accumulated problems, and even just to survive, staying afloat.

Chamber of entrepreneurs of Kostanai helped to business entities to unite, and its Regional Council only confirmed postulate commitment to improving the business climate. This is indicated by the results of the work of the Chamber and its supervisory body.

At a recent meeting were voiced specific figures and examples: there were reviewed more than 30 problematic issues during the year, each of which is systematic, as  it affects the interests of a number of entrepreneurs. Whether it's a rural farmer with outstanding debts, or a head of urbanized company with its problems related to monopolists and regulatory authorities.

In particular, there was made a following announcement: "a positive decision on non-compliance and violations on the part of transportation enterprises was adopted, thus, imposing administrative punishments on violators", which was introduced to the new edition of the Code. If to think, production companies do not want to pay for "overload" during transportation of goods. Rather, it is a reason to reflect: is business, in this sense, an inexhaustible source of replenishment of the budget, which more than others wears out road arteries of the country? After all, when the amount of fines imposed is several times higher than the cost of transportation itself, one can’t reason in a different way. Members of the Regional Council, also judged and addressed through NCE to lawmakers. As a result the amount of fines was reduced.

Or another example: "there were introduced changes in legislation and extended the deadline for the mandatory installation of POS-terminals for business entities, applying the special tax regime”. Now at the stage of resolution is the issue of the Regional Council on liberation of farmers on VAT payment for import of spare parts for imported agricultural machinery. They also discussed the problematic topics on the work of free warehouses as of 2017 and the creation of a collegial body for resolution of tax and customs disputes, which are also a common case.

Someone might say, that there are lawyers and there is no need the Chamber. However, they are not always able to independently raise systemic problems and solve them at the legislative level.

Are they scared of fines? Are their rights observed?

Special attention is given to the so-called direct protection of business. According to the director of the Chamber Murat Abenova, in Kostanai region there are 26 concrete examples of when the sexperts of the organization have defended the interests of a number of businessmen. They helped to save about 500 million tenge - fines, penalties and other costs that are entrepreneurs managed to avoid paying.

There is another breathtaking example relayed to seven advertising companies of Kostanai. In 2014, the city administration refused companies to extend permits for the lease of land plots for billboards. The reason - the "moratorium" announced by the then Akim, though the Land Code didn’t say a word. Moreover, the businessmen said that from now on, instead of the usual billboards, they have to install scrollers - dynamic advertising and at their own expense include bus shelters.

Naturally, Chamber considered all these actions illegal. They were trying to solve the issue for more than six months. The question was considered at the meeting of the Council on protection of the rights of entrepreneurs. But, alas, no result. As a result, with the assistance of the regional prosecutor's office, there was put an end to the story at the court. The decision was made in favour of entrepreneurs.

Another example? Nariman market in Kostanay wasn’t closed for reconstruction because with the help of the Chamber was found a compromise between the regulators and vendors. Merchants have saved their jobs and 40 million tenge on renovations of boutiques.

By the decision of the court one of the regional mill processing plants was released from a fine in the amount of 3 million tenge. This is the question of losses not significant for the economy, but for an individual firm. In early 2014 there was in circulation a highly publicized case involving an automated control system of weight parameters, which was malfunctioning on the section of the highway Auliekol-Surgan. However, before it became clear, employers have send fine tickets in the amount of 320 million tenge to entrepreneurs. And if not for an appeal to the Chamber, businesses would have to pay for it.

A business entity in Auliekol District got an assistance with the restructuring of a loan, so he avoided bankruptcy. To two businessmen from Kostanai and Denisov Districts got assistance with obtaining land for the business.

And so on down the list. You can continue, but the essence is shown quite clearly. Entrepreneurship is a risk and, in the case of aggravation, it is difficult without skilled and timely help. Will the business be able to ensure it alone? Possibly. But it is reasonable to ask: what is the point of going through the path of greatest resistance.
