Liabilities must be fulfilled
The Chamber of entrepreneurs assisted the entrepreneur to collect the debt owed by the state enterprise
They say that fulfillment of a contract is compulsory at any time. But any entrepreneur is concerned about the fulfillment of a contract and getting a payment.
Within two years, the company unsuccessfully tried to collect the arears from the state enterprises. And only the intervention of the Chamber of Entrepreneurs helped to shift the situation from a deadlock.
In January 2013 LLP "Kaztorgtechnika" and Municipal Utility Service "Kapshagayzhylu" on the right of economic management of Akimat of Kapshagay have signed an agreement according to which LLP "Kaztorgtechnika" pledged to install 33 heat meters, to carry out commissioning, as well as to develop a design and estimate documentation.
LLP has fulfilled its obligations in full and within the time frame, but the utility company didn’t repay the entire amount. So, out of the amount due by the contract 18,267,849 tenge, the receiver of services paid only 6,198,445 tenge. Thus, the balance due under the contract amounts to KZT 12,069,403, which is confirmed by the verification of mutual settlements signed between the parties.
"With the assistance of the Chamber of Entrepreneurs MUS "Kapshagayzhylu" transferred to the account 4 million tenge for repayment of debt in December 2015. The outstanding balance of 8 million tenge, the company has promised to pay off in two months in 2016, otherwise the debt will be levied by the courts", - said the expert of 1st category of the legal unit of RCE Diaz Otashbaev.
