An error worth thousands
The tax increased eleven-fold for Kostanay company due to an error of an employee of RSE "Scientific-Production Center of Land Cadastre"
To fix it, the company needed the help of the Chamber of Entrepreneurs and the Prosecutor’s Office.
In 2008 LLP "Athena Pallada" bought a land plot for an industrial use in Kostanai region, outside the settlement area. Last year, the company decided to optimize production and to divide the land into two separate zones.
The entrepreneur received new acts at RSE "Scientific-Production Center of Land Cadastre", but they indicated the wrong category "land settlements (cities, towns, and villages)". As it was found out later, the rate of land tax has changed. Instead of the previous 9 142 tenge, the company had to pay 100,633 tenge.
Representatives of LLP demanded to correct the error, but an expert of RSE refused, citing to the fact that the akimat determines the category of the land plot. Akimat was insisting on the opposite: the department of land relation always refers to the data of RSE. In the end, the firm appealed to the Chamber of Entrepreneurs.
"We thoroughly researched the issue and found a clear violation of the rights of entrepreneurs. The land plot, which is located outside the village, initially can’t be referred to the category of a land settlement. We sent a letter to the district prosecutor's office. Employees of the Supervisory Authority send a responding query to the branch of RSE ""Scientific-Production Center of Land Cadastre". As a result, LLP will receive the new state certificate with the former category. Thus, it will not incur additional financial costs", - said the expert of the Chamber of Entrepreneurs of Kostanay region Anuar Kuzhakhmetov.
