Lift gate as a "barrier"
A lift gate was blocking access to the complex “Vizavi”, thus, it prevented successful business operation
"Thank you so much for the prompt and competent solution of this issue, as well as for protection of our interests!" - Such warm words in a thank you letter were addressed by a businesswoman, an individual entrepreneur Kulpash Galieva to the Chamber of entrepreneurs of Akmola region.
It is easy to understand the emotions of the businesswoman. The path of any entrepreneur is not easy, and sometimes it is full of obstacles, and it will take time to make profit, as each day requires hard work.
Everyday work since the beginning of this year, the business-woman had to face harsh reality. She owns a multifunctional complex “Vizavi”, which provides all the conditions for the population. However, road access to the complex was suddenly blocked from the side of an adjacent shopping center and an apartment building. The cooperative of apartment owners "Dostyk" took a decision to install a lift gate.
Without hesitation, the owner appealed to the Department of Housing Inspection of Kokshetau. But there was no response. Then she appealed to the City Department of Architecture and Urban Development, Office for Emergency Situations, but the decision on this issue was delayed.
"I have visited al authorities, but the result was zero. The current bureaucratic system out under jeopardy our business and financial solvency of our company, but the cooperative of apartment owners continued to block driveways, lobbying, apparently, the interests of certain individuals. When I lost hope, people advised me to address for assistance to the Chamber of Entrepreneurs of Akmola region ", - says Kulpash Galieva.
It is noteworthy that the necessary decisions were taken in the shortest possible time, which ensured the successful resolution of the problem.
"By its actions cooperative of owners of apartments “Dostyk” hindered business activities of the individual entrepreneur Galieva by installing barriers, thus creating an artificial barrier to the complex “Vizavi”. Moreover, the lift gates were on the state land without any authorization documents", - says the head of the department of legal protection of entrepreneurs of RCE Rasul Syzdykov.
At the initiative of the Chamber, the case was referred to the court. A key role in the course of court proceedings, according to the business-woman, played not only the competence of the experts of RCE, but their simple human participation.
The case was reviewed at the specialized inter-district economic court of Akmola region. The court ruling was adopted in favor of the plaintiff.
