The court of appeal gave two years of probation to Vladimir Kryuchkov
Karaganda businessman Vladimir Kryuchkov has remained at large. Conditionally
The Regional Court found that LLP "Tabigat XXI” did not violate the safety regulations during construction work on a dam reservoir Kokpekty.
In June this year, the business community of Karaganda was angry, after learning about the court verdict of Bukharzhyrau district on this case. As a result of dam failure and flooding at night from 30th to 31st of August, in 2014 five people in the village Kokpekty were killed, 50 houses had to be rebuilt. Three people were prosecuted as a result – head of the district Department of Emergency Situations Rishat Zhantulikov and former akim of the village Kokpekty Bakhytzhan Smailov who have been charged with negligence that led to serious consequences (Part 2, Article 316 of the Criminal Code). But everyone's attention was riveted to Vladimir Kryuchkov, the founder of LLP "Tabigat XXI”, which leased Kokpekty dam. He is charged with just two articles - violation of safety regulations during construction (Article 245 of the Criminal Code.) And abuse of power (Article 228 of the Criminal Code.).
"In general, the guilt of all convicted was fully proven by the verdict of the court of first instance. However, the board believes that in respect of the convicted person Kryuchkov was incorrectly applied part 2 of the Article 245 of the Criminal Code, as a court and investigation didn’t determine exactly who and when produced construction works, which were carried out in violation of the rules, which entailed further consequences. Nevertheless guilty under Article 288 of the Criminal Code is complete. In this regard, the verdict against Kryuchkov is subject to change - two years of restriction of freedom", - the chairman of the appeals board Rashid Nurmagambetov read the decree.
The court upheld the consideration of complaints of residents of Kokpekty on reimbursement of material damage. Now the villagers, who consider the amount of compensation received insufficient, may have to hire lawyers and to put claims on convicts in civil procedural order.
Board of Appeals recognized that action of Rishat Zhantulikova, Bakhytzhan Smailov and Vladimir Kryuchkov regarding abuse of power Court of First Instance is properly qualified. But as for security of construction work, the servants of Themis came to the conclusion that the allegation has not been confirmed. And so, it means that the entrepreneurs are not guilty.
"I do not consider myself guilty. Ten years I beat all the bells, the dam accident, but officials would not listen. Before the dam break the staff of my company did everything possible to minimize losses and avoid casualties. Of course, thank you that the board sorted out and took off my charges under Article 245. But we will appeal it", - said Vladimir Kryuchkov to online edition Ratel after the trial.
