The "Atameken" committee takes a self-regulation system to new level
How to accelerate the development of SROs and ensure the responsibility of the business for the safety of work before the consumer? This was discussed at the first meeting of the Committee for the Development of Self-Regulation under the Presidium of the NCE RK "Atameken".
First of all, the members of the Committee introduced the Chairman, congratulating him on his new public position. He is Ulan Baizhanov - a master lawyer with a great experience in the field of jurisprudence.
"To be honest, I have an ambiguous attitude to your congratulations. In fact, we have a rather difficult job. The law on self-regulation was adopted in 2015, but no significant progress has been made on it. Now our main task is to understand why state bodies are not active enough and there is no positive dynamics in this issue? And, secondly, it will be necessary to give a noticeable impetus to the process of self-regulation development," - the Chairman of the Committee for Development of SRO under the Presidium of the NCE RK "Atameken" Ulan Baizhanov said.
To date, mandatory self-regulation has been introduced in two areas only - valuation and legal services. Of course, this is not enough, Ulan Baizhanov stated. The SRO system is aimed at making the business able to improve the productivity of its existence in the market and fully responsible for quality and safety to the consumer.
That is why the Committee together with the Ministry of National Economy must deal with a radical "reset" of legislation in this area. First of all, it is necessary to establish clear criteria - which business is the SRO, and which is not.
"The Association for the Recycling of Secondary Metal, the Association for the Sale of Railway Tickets, the Association of Bookmakers comes to us. And they all say that they are SROs. Is it so? There are no elementary professional standards, which, in fact, is the key difference between the SRO and the association. We initially need to understand who our customers are? Within the Committee, it is necessary to work out this concept. It is necessary to determine the conditions under which SRO should be introduced in professional and entrepreneurial activities," - Deputy Chairman of the Board of the RK "Atameken" Rustam Jursunov said at the meeting.
An example, where voluntary self-regulation is successfully introduced, can be called the sphere of elevator economy of Astana. Business, which deals with the maintenance of lifts of high-rise buildings, implements uniform standards and creates conditions to exclude accidents. At the same time, it increases its own responsibility for ensuring the safety of people.
In order to interest entrepreneurs in the process of self-regulation, the Committee developed an action plan.
The first block provides for the development of voluntary self-regulation. Based on the world practice, the introduction of mandatory self-regulation should be based on a qualitative layer of voluntary SROs. In this regard, it is necessary to form statistical data on the number of entities on the market and determine the conditions for their consolidation into a voluntary SRO.
In addition, specific measures are planned to increase the responsibility of the SRO for the quality of goods, works and services. Depending on the type of activity, it will be achieved through a system of standardization and the establishment of uniform qualification requirements. Approaches to the use of insurance instruments and the formation of security funds have been determined.
The revision of existing regulatory tools and the definition of an optimal model of self-regulation will be the final stage.
In turn, Ulan Baizhanov asked members of the Committee to submit their proposals to the Work Plan. He stressed that in the end, the planned set of measures should create a solid basis for the qualitative formation of self-regulating organizations in Kazakhstan.
