“ATAMEKEN” - CONDITIONAL DISCOUNTS DO NOT SUPPORT DOMESTIC PRODUCERS IN STATE PROCUREMENT

The National Chamber explained why the transfer of criteria affecting the price offer for public procurement to the sub-legal level will not weaken the support of domestic producers.

"Atameken" reminded that from August 1, 2017 it became optional to specify the requirements on the availability of national standards of Kazakhstan in the technical specification. This was contrary to the principle of transparency of procurement and did not protect customers from the supply of low-quality goods


All this time, the National Chamber has been working to return the rule on the mandatory indication of national standards of the Republic of Kazakhstan to the procurement rules. As a result, in July 2018, NCE succeeded in making changes to the procurement rules.


“Understanding the instability of the bylaws, "Atameken" insisted on the need to fix the relevant norm in the Law on Public Procurement. In order to strengthen the support of domestic producers, the National Chamber introduced the proposal into the draft law on public procurement issues,” - Kuanysh Bishimov, Deputy Chairman of the Board of the NCE “Atameken”, said.


As for the criteria affecting the price offer, which was discussed during the plenary session of the Majilis of the Parliament of the Republic of Kazakhstan, national standards now give an advantage to suppliers only in the form of a 2% conditional discount. At the same time, the provision of national standards is the right of the supplier, and not an obligation, and does not fully provide the advantages of domestic producers.


“In this regard, the National Chamber raises the question of ensuring the availability of a national standard to become mandatory for public procurement. The state purchases law should include national standards,” - Kuanysh Bishimov notes.


According to the Deputy Chairman of the Board of the NCE, it is this approach that strengthens the protection of the interests of domestic producers, since importers will have to receive the national standard of the Republic of Kazakhstan for participation in public procurement.


“Thus, the transfer of criteria to the sub-law level, about which the deputy of the Mazhilis of the Parliament Pavel Kazantsev raised the issue, will weaken the support of domestic producers in no way. Proposals of the National Chamber on the legislative consolidation of the duties of potential suppliers to provide documents confirming compliance with national standards will give more advantages to domestic producers than just a conditional discount,” - Kuanysh Bishimov concluded.
