According to the entrepreneur, they acquired non-residential premises with two entrances (through a parking lot and through a technical room with engineering networks to the street), where a training center was organized. The “BI Service” service company, according to the complaints of the tenants of the house, restricted access from the street to the technical room to enter the NP of the entrepreneur, and earlier the access of clients of the training center through the parking was prohibited. Thus, the premises of the entrepreneur were simply isolated.
“In May of this year, I bought this office with an area of 27 sq.m. I took a mortgage through the bank. The bank approved it and issued as a "non-residential premises". According to the documents, the office has two entrances: through the parking and from the technical room. For three months I did repair works both inside and in the technical room. I have already started working a month ago. Since then, residents and representatives of the service company began to claim. I was forbidden to use entrances from both sides. Also in the morning they turned off the light, water, heat and removed all locks from my doors. Before the arrival of the "Business Rescue Service", no one wanted to talk to me, to make contact. Thanks to "Atameken", today we had a constructive dialogue for the first time and we came to at least some kind of agreement,” - Sandugash Baysadykova, Director of StudyClub LLP, explains.
The engineer of the service company argued that access to the technical room was limited by the fact that there were all the utility networks of the house (including the heating network) and people were not safe in such a room, and that the room is in the condominium and is the common property of the residents.
“Having heard the problem of an entrepreneur, we held talks with representatives of a service company and an initiative group of tenants. After long negotiations, we came to an agreement. Electricity was connected, access from the street to the technical room to enter the non-residental premises of the entrepreneur was open until Monday, so that she could hold a planned presentation for clients. The Service Company was also invited to assist in holding a general meeting of tenants for obtaining permission to access the entrepreneur’s NP through this technical room or through a parking lot,” - Nurzhan Bukin, expert of the Chamber of Entrepreneurs of Astana city, said.
The meeting will be held on October 25, which will be attended by residents of the house, management and representatives of the "BI Service" service company, as well as employees of the Chamber of Entrepreneurs.
