"THERE IS INTEREST!" PROJECT ON PROTECTION OF INVESTORS' RIGHTS SHOWED FIRST RESULTS

Representatives of the Agency for Civil Service Affairs and Anti-Corruption in the Republic of Kazakhstan jointly with the NCE RK "Atameken" and "Kazakh Invest" JSC summarized the results of the activities of the "Protecting business and Investments" project office in the field of anti-corruption protection of business and investments.

The project office at Agency for Civil Service Affairs and Anti-Corruption began working four months ago. During this time, 162 agreements were signed, 50% of which with foreign investors on anti-corruption support of investment projects worth over 5.9 trillion tenge.

The regional project offices received 153 appeals, 128 of which were supported.

“We are seeing a significant interest of large investors and foreign experts in the program. This work must be intensified. We need the resources of Atameken, especially the well-functioning work of the regional chambers,” - Olzhas Bektenov, deputy chairman of the Agency for Civil Service Affairs and Anti-Corruption, noted.

It is worth noting that the National Chamber is actively involved in the work of the project. According to Rustam Zhursunov, Deputy Chairman of the Board of the NCE RK "Atameken", it is necessary to identify investors in each region and identify systemic problems on the basis of particular problems in them.

“All regional systemic problems should be included into a single register of business problems. The regional chambers should take action to resolve each issue included in the registry. I draw your attention to the need to establish a weekly exchange of information between the project office and the Agency,” - Rustam Zhursunov said. - “Problems that need to be resolved at the republican level will be submitted to the National Chamber for consideration.”

The most frequent problems of investors are insufficient competence of state bodies, for example, employees of state bodies cannot explain the procedure for rendering services, there are corruption, duplicating and unjustified control and supervisory functions, obtaining technical conditions for connecting the object to the power grids.

Part of the question of connecting objects to the power grid is resolved at the legislative level. It is associated with the excessive use of energy companies by their monopoly position, as Oleg Savelinko, director of the department for legal protection of entrepreneurs at the "Atameken". According to the law “On Natural Monopolies,” an Internet resource of a natural monopoly subject (NMS) must contain information about free capacity.

“We have not determined the state agency authorized to evaluate the information contained on the NMS website. The legal act regulating the requirements for the content of the site is not fixed,” - Oleg Savelenko noted.

These factors do not provide transparency of information about the workload of objects. The procedure for the use of electricity provided by the procedure is complicated. The entrepreneur loses time, money, thereby creating corruption risks.

The National Chamber together with the business community proposed amendments to the legislation in terms of revising the system for considering applications for technical conditions, based on the experience of Kyzylorda and South Kazakhstan regions. However, the services of monopolists are not digitized.

“We need clear procedures for the interaction of subjects of monopolies with the state corporation for the provision of services in electronic form,” - Oleg Savelinko outlined.

Today, within the framework of digitalization, each akimat is developing in its own direction by introducing interactive maps, activating online issuance of services, and so on. Rustam Zhursunov noted that in order to integrate digitalization projects, the process of creating unified technical conditions were launched on the example of the Kyzylorda region for further development in the regions.

The question of the need for uniform conditions was supported by Olzhas Bektenov, who noted the convenience of digital platforms for the business community.
