ATAMEKEN IS READY TO ASSERT RIGHTS OF THE "MOSCOW" SEC
According to the Regional Chamber, the safety of visitors is first, but the suspension of the activities of the shopping and entertainment center is an excessive measure.
The Chamber of Entrepreneurs of Almaty is ready to defend the legitimate rights and interests of the "Moscow" SEC and advise the entrepreneur on appealing a court decision on the lawsuit of the Emergency Situations Department of the city of Almaty to MOSKVA Metropolitan LLP in the Supreme Court.
“The Chamber of Entrepreneurs of Almaty is well aware that the fire safety standards are very important. Of course, the safety of the citizen, the visitor is in the first place. At the same time, we believe that the suspension of the activity of the “Moscow” SEC is an excessive norm. We believe that it is possible to resolve this issue in other ways and are ready to assist the "Moscow" SEC in appealing a court decision in the cassation authority of the Supreme Court. We will also help to find a compromise for an entrepreneur in cooperation with authorized state bodies. According to our data, at the time of the project, the ES authorities did not carry out an examination, that is, the project was not inspected prior to construction. In this regard, the NCE should consider the option of including emergency bodies in the expert committee during the examination of construction projects so that other entrepreneurs do not have similar problems in the future,” - Deputy Director for Legal Affairs of the Chamber of Entrepreneurs of Almaty Aituar Koshmambetov said.
Protecting the rights and legitimate interests of business is one of the priorities in the activities of the National Chamber of Entrepreneurs of Kazakhstan "Atameken". The Chamber of entrepreneurs of Almaty is ready to provide legal advice to any entrepreneur. Over the five-year period, 23.5 thousand applications from entrepreneurs were received by the NCE RK "Atameken", more than 40% of which were positively resolved. Since the beginning of 2018, the Chamber of Entrepreneurs of Almaty has retained the property rights of the business in the amount of more than one billion tenge.
Earlier, the Almaty City Court distributed information about the suspension of activities related to the operation of the building and the territory of the "Moscow" SEC until all violations of of fire safety regulations and rules were completely eliminated. Violations were revealed during the inspection by the specialists of the Emergency Situations Department of Almaty. All the comments specified in the inspection report, with the exception of the fire breaks from the building of the Sarita cafe, were eliminated. This violation was not the fault of the mall.
