Kazakhstan adopts new rules for sale and use of gas

Starting from July 29, 100% prepayment will be canceled for domestic consumers who buy gas from suppliers, and also no penalties will be imposed for shortages and oversupply of gas.

A considerable number of complaints from small and medium businesses (residential consumers), which purchase marketable in their business activities without the purpose of its resale, became the starting point for revision of the legislative acts. The business appealed to the Atameken NCE RK, they disagree with the terms of the concluded contracts. They got gas only on the terms of 100% (advance) payment. In addition, due to the lack of advance payment, the supplier charged a fine.

The rules allowed for unevenness of gas supply by months only for household consumers (population), in this regard, the contracts with household consumers included the conditions providing for payment for shortage and oversupply of gas.

The National Chamber repeatedly raised this problematic issue, the Atameken held working meetings at different levels to work out the ways of solution.

Following the results of the work, at the initiative of the National Chamber of Entrepreneurs, the relevant amendments were introduced to the Order of the Ministry of Energy of the Republic of Kazakhstan No. 96 "On Approval of the Rules for Retail Sales and Use of Marketable and Liquefied Gas" dated November 3, 2014. The adopted amendments provide for payment by municipal consumers for the actually consumed volume of gas, which complies with the requirements of the Civil Code of the Republic of Kazakhstan, as well as the abolition of penalties for shortages and over-expenditure of gas volumes.

Amendments were made by № 241 Order of the Ministry of Energy of the Republic of Kazakhstan dated July 11 of this year.
