Atameken considering concept of draft law on public procurement

The Atameken National Chamber of Entrepreneurs of the Republic of Kazakhstan received the Concept and comparative table of the draft law on public procurement, which is aimed at improving the system of public procurement by improving efficiency, transparency and minimizing corruption risks.

The Concept provides for:

-       the improvement of the public procurement system by increasing efficiency, transparency and minimizing corruption risks:

-        the establishment of administrative responsibility of officials for illegal admission of an application to procurement and untimely inclusion of suppliers in the register of unscrupulous participants.

-       the introduction of a new method of procurement "tender with the use of framework agreements" in the centralized procurement of simple, standard goods, works, and services to simplify public procurement procedures.

-       the introduction of e-shop due to the development of e-commerce.

-       the creation of an electronic repository of documents that have been verified for their authenticity.

-       the establishing restrictions related to the participation in public procurement of companies if their managers (founders) have been prosecuted for corruption crimes, as well as establishing annual volumes (limits) of participation of potential suppliers in public procurement for small and medium businesses.

-       the creation of the Register of Customers and Potential Suppliers, which is entitled to conclude contracts on public procurement through the direct conclusion of contracts.

-       the establishment of dumping thresholds in public procurement to exclude cases of dumping prices (unreasonably low prices).

-       reducing the terms of the public procurement process by providing the possibility of public procurement from a single source for failed public procurement in cases of absence of submitted bids or submission of only one bid.

-       increase of threshold values of procurement by way of a request for quotations from 4,000 times to 8,000 times the size of the MCI.

-       the reduction of purchases from one source by the direct conclusion of the contract by excluding purchases from one source of insignificant goods purchased under subparagraph 42) of paragraph 3 of Article 39 of the Law.

-       the establishment of payment for complaints by charging a fee for filing complaints.
