Pilot project on footwear labeling launched in Kazakhstan
The Atameken informs that in accordance with the order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan has launched a pilot project on labeling footwear in the territory of the Republic of Kazakhstan. It will be valid from July 30, 2019, to March 31, 2020.
The purpose of the pilot project is to understand and analyze the expediency of introducing marking and whether its introduction can solve the problem of grey import and counterfeiting.
The pilot project is carried out voluntarily with the free issuance of labeling codes.
The National Chamber of Commerce of the Republic of Kazakhstan has formed and sent to the Ministry of Foreign Affairs of the Republic of Kazakhstan the list of companies participating in the pilot project on marking of footwear goods, which includes both importers and manufacturers (Darkhan-MNM LLP, Kazlegprom-Almaty LLP, TarazKozhobuv LLP, NAIZA Group FE, Z-Shoes, Business Network 2013 LLP, etc.).
We note that it was the National Chamber of Entrepreneurs insisted on the fact that it is impossible to introduce mandatory labeling without pilot projects, feasibility analysis and analysis of the regulatory impact of the pilots. Thus, the business has the opportunity to test the labeling and draw a conclusion on the level of its impact on business.
Also, the Eurasian Economic Commission is working on the issue of mandatory marking of footwear in the EAEU. This issue has been submitted for discussion to the Council of the Eurasian Economic Commission. As part of the draft decision on the introduction of mandatory labeling included a paragraph that each country of the Union will independently determine the terms of the introduction of mandatory labeling in its territory.
At the same time, the mandatory footwear labeling requirements came into force in Russia in early July of this year and currently the Russian entrepreneurs are registered in the labeling information system.
In the case of footwear export to the Russian Federation, the domestic entrepreneurs must label the footwear following the requirements of the Russian Federation.
Taking into account that the mechanism of marking in cross-border trade is not clear enough (with the introduction of marking unilaterally), the Chamber applied for clarification to the Eurasian Economic Commission in July, because the Commission is a supranational body that ensures the execution of decisions and free movement of goods in the internal trade in the EAEU. To date, no response has been received from the Commission.
According to the pilot project, footwear goods on the goods items of the Commodity Nomenclature of the Foreign Economic Activity 6401-6405, imported or produced in the Republic of Kazakhstan, are subject to labeling. In the course of the pilot, the traceability of the movement of the labeled goods along the whole chain will be carried out, from the moment of putting into circulation (production/import) to the withdrawal of goods from circulation (retailer).
The National Chamber of Commerce suggests the business community take an active part in the pilot project on footwear labeling to test all business processes and identify problematic issues. Also, all issues related to the introduction of labeling can be discussed at the site of the Project Office on labeling issues (established under the Atameken NCE RK), where all related issues are discussed regularly with the authorized state bodies.
