Crimes against business should be grouped in separate chapter of Criminal Code – Kulibayev
Timur Kulibayev, Сhairman of the Presidium of the Atameken National Chamber of Entrepreneurs, proposed to review the penalties in the Criminal Code for crimes against a business.
Nur-Sultan hosts the IV forum on business protection "Supervision of the Prosecutor's Office in the field of entrepreneurship", the participants discuss the results of the implementation of the Roadmap for 2019, signed by the General Prosecutor's Office and Atameken NCE RK.
In his welcoming speech, Timur Kulibayev noted that more than 90 joint activities have been implemented in Kazakhstan. He noted the beginning of systematic work on the humanization of criminal legislation.
"This has also had a positive effect. As a result, the registration of criminal cases in the economy has been reduced by 5 times. Over 20,000 businessmen have stayed in economic turnover for 3 years of reforms, kept their enterprises and, consequently, jobs," he said.
However, he pointed to the problems of business related to the interference of officials. Entrepreneurs have to apply to all authorities and public institutions. According to the legal statistics, more than 50,000 complaints were registered in 2018, while disciplinary action was taken against only 61 officials.
He noted that criminal and administrative measures do not work in practice, everywhere there are almost zero statistics. The system of checks and balances also does not work. Timur Kulibayev believes that crimes against a business should be comprehensively reviewed, expanded and grouped in a separate chapter of the Criminal Code.
"Business needs confidence in the future and a guarantee of the inviolability of private property. The judiciary and judges play an exceptional role in this case. The Supreme Court takes active measures to eliminate formalism, eliminate inequality in disputes between business and the state apparatus, and improve the quality of the judiciary. The business community supports these initiatives. I propose to take into account the positive practice of the AIFC court for the resolution of commercial disputes," Timur Kulibayev summed up.
