We need a law that regulates the procurement procedures in the quasi-public sector

This was announced at the fourth meeting of the Anti-Corruption Council of NCE  RK "Atameken" by its chairman Azat Peruashev.

According to him, deputies of Mazhilis have already addressed to the Government of the Republic of Kazakhstan with a proposal for the adoption of such a law, in 2013 the Ministry of Finance gave a written consent. However, the Government believes that there is no need to adopt a law on procurement, for example, Russia has a framework law. However, according to Azat Peruashev, State Duma of the Russian Federation is now considering Procurement Law, which provides direct measures of protection of domestic producers. Meanwhile in Kazakhstan, such protection measures are not spelled out.

"I will again appeal to the Government to consider the adoption of procurement law that would regulate the procedure of procurement. Today we have a situation where with the presence of model rules approved by the Government, "Samruk-Kazyna", each company adopts its own rules, and, as practice has shown, they don’t comply with them. Nobody punishes them and the worst thing that can follow is only a reprimand", - said the chairman of the Anti-Corruption Council of NCE RK "Atameken".

Azat Peruashev also drew attention to another point: quite often the organizers of procurement set qualifying conditions for a particular vendor with whom they intend to contract, thereby filtering out the rest of the participants.

In this regard, in his opinion, NCE approached with the right proposal, suggesting to amend the procurement rules, the project involves placing the tender documents 10 business days prior to its approval.

"In this case, the Chamber will have an opportunity to respond, industry associations will be able to make proposals, thus, avoiding the creation of an advantage conditions to one particular supplier in order to ensure open, fair competition, not lobbying interests of individual companies", - says Azat Peruashev.
