The Chamber rescued the businessman from the inclusion in the register of unfair suppliers
Last year, LLP "GeoMaps" appealed to the Chamber of Entrepreneurs, complaining on violations in the field of public procurement on the part of the paramilitary branch of blowout detachment RSE "Ak Beren".
The point is this. In May 2015 LLP "GeoMaps" and a branch of Kyzylorda State Enterprise "Ak Beren" signed an agreement on public procurement, according to which one party undertakes to supply drinking water to the office of "Ak Beren" within 90 days. However, as it was revealed by LLP, the customer had no decision of the local executive body on the water supply to the office and then sent a letter to "Ak Beren" on 8th of July the with the request to take appropriate measures related to the adoption of the decision. But the branch sent a statement that the permit will be issued by the Akimat only on 31st of July.
In general, in accordance with the current legislation for the preparation of design and estimate documentation, the customer sends the to the contractor the required data, in particular, the document with the approval of the decision by the local executive authority.
However, the customer - a branch of Kyzylorda RSE "Ak Beren" has not provided the relevant documents to a businessman. In addition, it addressed to the court to include the company in the register of unfair suppliers for non-delivery of the service within the period.
Employees of the Chamber participated in the court hearing as a legal representative of the entrepreneur on order to protect his rights.
As a result Kyzylorda oblast specialized inter-district court took into account all the above reasons of the entrepreneur on the timely execution of works, stipulated in the contract, and dismissed the claim of LLP "GeoMaps" against RSE "Ak Beren" on the inclusion in the register of unfair suppliers.
