Entrepreneurs promise to fulfill the requirements that have been implemented a few years ago
In 2013, the Specialized Inter-district Economic Court of Almaty satisfied the claim of Municipal Utility Service "Tospa Su" to entrepreneur Khalip Muratova that the latter is obliged to shift a sewer system to a distance of more than 3 meters from the entrance to the cafe owned by Muratova. The problem is that these requirements have been observed by the entrepreneur during the construction.
Despite of this, the private bailiff repeatedly sent to the judicial authorities the claim for penalty to recover from IP Muratova in the amount of 5 MCI for each day of delay due to the failure to fulfill the judgment, finally the entrepreneur has debt of 1 million 700 thousand tenge. The private bailiff forged the signatures of Muratova and gave the court a document certifying that the businesswoman received the notification about the need to comply with the judgment. A criminal case was initiated in October 2015 by the fact of falsification of documents, the final decision on which has not yet been adopted.
Thus, the rights and legitimate interests of the entrepreneur were violated due to the illegal actions of the bailiff and groundless judgment.
It is worth noting that in October 2015 Muratova ordered the technical expertise, which concluded that the cesspit is located at a distance of 12 meters from the entrance to the lobby of the building, which fully complies with building regulations.
After the address of a businesswoman to NCE, the Chamber has sent a letter to the Department of Justice of Almaty to stop the decision of the court in connection with its execution. The response from the authorities has not been received yet.
