Experts of the regional Chamber forced abolition of illegally accrued penalty on the entrepreneur
Thanks to the support of the Chamber of entrepreneurs, the businesswoman Tatyana Bespalova escaped penalties that the State Revenue Department tried to impose for the same offense twice.
As it was stated by the expert of RCE of the department on protection of the rights of entrepreneurs and reduction of administrative barriers Seyfolla Kasymkanov, SP “Bespalov” addressed to the Chamber regarding the actions of the fiscal authorities, who sent in her address a notification on elimination of violations of the tax legislation.
As shown the study of the case, the entrepreneurs made late payment of the annual license fee for the storage and retail sale of alcoholic beverages.
However, according to Seyfolla Kasymkanova previously on this fact Tatyana Bespalova has already been brought to administrative responsibility. And this is despite the fact that there are rules of law that prohibit to bring to administrative responsibility for the same offense.
In order to prevent flagrant violations of the rights, the experts of the Chamber of entrepreneur prepared an appeal to the regional department of public revenues. Here, following the consideration of the decision was made a decision to satisfy the appeal and to recognize the actions of tax service illegal. Thus, it was possible to prevent illegal re-imposition of penalties.
In total, the Regional Chamber of Entrepreneurs protected the rights of 98 businesses in 2016, totaling 1,752,347,895 tenge.
An effective measure to radically improve the business environment is the introduction of the institute of the Business Ombudsman, high status and extensive powers of which allow to deal effectively with systemic problems of Kazakhstani business, arbitrariness of officials and imperfection of the legislation.
During his working trip to Pavlodar region in July last year, the Business Ombudsman Bolat Palymbetov met with akim of the region and the prosecutor, where he discussed the problematic issues of entrepreneurs in the region.
For example, activated the work on granting of land plots through auctions. Thus, during this period 7 auctions were held (same period 2015-4), 109 land plots were transferred for temporary use (same period of 2015- 41).
