Belarus Customs abolished its requirements to a Kazakhstani entrepreneur

Individual entrepreneur Mashanlo I.L. was fined on the initiative of the Oshmyan Customs of the Republic of Belarus. According to the customs authorities, when transporting goods to the Kyrgyz Republic, he violated the requirements of Chapter 27, Articles 81, 150 of the Customs Code of the Customs Union (unreliable declaration of the value of the goods being transported when importing into the customs territory of the EAEU). According to the Oshmyany customs, the carrier Mashanlo I.L. when importing goods into the territory of the EAEU, underreported information about the value of the goods. The total amount of property claims of the Oshmyany Customs made to the businessman amounted to more than 800 million non-denominated Belarusian rubles, which, in terms of the current tenge, is over 13 million tenge. However, the entrepreneur did not import goods into the territory of the EAEU, but went in transit through its territory, since the destination was Kyrgyzstan, and at the time of the issuance of protocols on administrative violation (May 12, 2015), the Kyrgyz Republic was not a member of the Customs Union (the Treaty of Accession of the Kyrgyz Republic To the Treaty on the Eurasian Economic Union of May 29, 2014 entered into force on August 12, 2015). The entrepreneur, defending his rights, lost two courts and appealed to the Supreme Court of the Republic of Belarus, as well as to the National Chamber of Entrepreneurs of Kazakhstan "Atameken". The Department of Legal Protection of Entrepreneurs of the National Guard prepared two appeals in defense of IP "Mashanlo I.L." - to the Prosecutor General's Office of Belarus and to the Supreme Court of Belarus. However, subsequently, the Oshmyan Customs withdrew its initial claims to recover 13 million KZT from the entrepreneur, and on May 18, 2017, the Supreme Court of the Republic of Belarus made a ruling on the abolition of lower court decisions and the dismissal of the case against Mashanlo I.L. Thus, the property rights of an individual entrepreneur Mashanlo I.L. were protected for 13 million tenge with the support of the National Chamber.
