Business under the protection of the prosecutor’s office
Illegal methods of pressure on business, exercised by the local executive bodies, should be stopped
This was discussed at an expanded board meeting of the regional prosecutor's office, held with the participation of the Chamber of Entrepreneurs.
At the board meeting were discussed the results of the work of the prosecutor’s office in protection of the rights of entrepreneurs.
"The main priority of the work of the Chamber is certainly protection of the rights of entrepreneurs, which would not be possible without close cooperation with the regional prosecutor's office", - noted in his speech the director of RCE of EKO Igor Shatsky. He named the Council for the protection of the rights of entrepreneurs the most effective platform.
According to Shatsky, most complaints come from business entities in the area of taxation, land relations, state procurement and licensing procedures.
In particular, in the field of taxation the most pressing issue is accrual of additional VAT on transactions with companies in respect of which the pre-trial investigation is conducted by the charges of pseudo-entrepreneurship.
"State and law enforcement agencies conducted a lot of work to identify cash in operations. In our opinion, this work is organized not in time, given the current economic situation in the country, as in certain cases the public authorities do overreach. The task of the Chamber in this situation is protection of bona fide contractors ", - said the director of the Regional Chamber of Entrepreneurs.
At the initiative of the Chamber under the Regional Prosecutor's Office was established a working group, which considers in detail transactions with pseudo-entrepreneurs.
Another acute problem in this area is the regulation according to which as of July 2015, business entities engaged in wholesale and (or) the retail sale of gasoline, diesel fuel, alcoholic beverages during cash commercial transactions must install cash register machines with online data transmission option.
For example, an entrepreneur, fully paid for the services of JSC "Kazakhtelecom", but in October the service was cut off without giving any reasons.
Moreover, upon application of the director of TC "Ridder Kazakhstan" regarding connection of existing cash machines to the Internet, employees of JSC "Kazakhtelecom" said that it is necessary to purchase a new control-cash machine having the technical capability to connect to the Internet, which is sold by JSC "Kazakhtelecom ".
It should be noted that the cost of one cash register is 250 thousand tenge, and the entrepreneur needs 5 of them, i.e. JSC "Kazakhtelecom" offers entrepreneurs to spend more than 1 million tenge to purchase devices that can work, transmitting data through Internet.
I would also like to emphasize that the existing cash registers of businessman are included in the relevant register and are approved for use on the territory of the Republic of Kazakhstan and the question of their connection to the Internet should in no way interfere with the normal activity of entrepreneurs.
Another important aspect is protection of property rights.
"The Constitution provides that the citizens of the Republic of Kazakhstan may privately own any legally acquired property. No one shall be deprived of his possessions except by court order. However, the prosecutor's investigation found evidence of misconduct of public officials that infringed the constitutional right of a business entities in protection of property rights", - said the head of the Department for Supervision over the legality in the socio-economic sphere under of Prosecutor’s Office of EKR Rustam Shiderdinov.
