NCE has protected the interests of a cotton producer
In 2014 LLP "Iasi group" (a member of the Kazakh Cotton Association) appealed to NCE RK "Atameken" regarding additional illegal charges, which were imposed by the tax authorities in accordance with the law on transfer pricing.
Joint work was carried out in protection of the company and provision of legal assistance in litigation on transfer pricing. Our participation in protection of the cotton business and well-prepared proposals and clarifications enabled the Government of RoK to approve a methodology for selecting the source of information on market prices in the export of cotton fiber, and the for General Prosecutor's Office to get to the core of litigation and to generate correct position on impeccable execution of the law.
As a result of these actions, the Supreme Court on 18th of May 2016 ruled in favor of the business, which is not only an example of the rule of law, but also serves as a precedent for all future solutions and specialized regional courts handed down in the area of transfer pricing of cotton exports.
During three years of litigation Ltd. "Iasi-group" with the State Revenue Committee MF RK on the legality of additional charges in the sphere of transfer legislation, finally ended in the court of highest instance of Kazakhstan, where was put the right emphasis and was determined the correct procedure for calculation of transfer prices. And this to the great extent is the merit of the National Chamber of Entrepreneurs "Atameken" and ULE "Kazakh Cotton Association", which have provided full support from the moment of appeal of LLP "Iasi-group".
