The ban on the transportation of goods from Ukraine to Kazakhstan through the territory of the Russian Federation

NCE RK "Atameken" brings to the attention of all entrepreneurs that on 1st of July this year the Russian President signed a decree, amending the Decree #1 dated by 1st of January  this year, which determines a special procedure for the import of goods from Ukraine to Kazakhstan via Russia.

In accordance with the new changes, a ban is introduced on the import of goods that are included in the "sanctioned" list of products as well as on all goods, import duty of which is higher than zero percent.

Thus, from 1st of July this year the transit through the territory of the Russian Federation may follow only those goods in respect of which Common Customs Tariff of the Eurasian Economic Union (CCT EAEU) stipulates a zero rate of customs duty.

As it was explained by the Deputy Chairman of NCE Dana Zhunusova, zero rate of CCT of EAEU is applied to the 1908 products, in respect of 80 of them zero rate of import duty is applied on an interim basis. Distribution of zero customs duties of CCT of EAEU by the groups of goods looks as follows:

• Engineering - 1103 items;

• Agribusiness and food industry - 161 items;

• Chemical industry - 159 items;

• non-precious metals and products from them - 120 items;

• vehicles - 111 items;

• light industry - 46 items;

• mineral products - 31 items;

• woodworking - 21 items;

• Precious stones and base - 11 items;

• other industrial goods - 144 items.

In respect of goods, which are permitted to be imported, is stored the previous order of transportation through the Belarusian section of the outer boundary of the EAEU with the mandatory use of seals on the basis of the GLONASS system.

However, from 1st of July this year the Decree also applies to transport from Ukraine to Kyrgyzstan. The validity of the Decree is extended until 31st of December 2017.

Also, according to the amendments to the Decree, in case of appeal of the Government of the Republic of Kazakhstan, the Russian government may allow the transportation of certain goods in respect of which there is a prohibition on the import from Ukraine to Kazakhstan. The effect of this item apply to sensitive products of the industrial group.

It should be noted that in accordance with the regulations of the Code (Presidential Decree "On the suspension of actions by the Russian Federation on Free Trade Zone Agreement with regard to Ukraine", the Russian President's Decree dated by August 6, 2014 # 560 "On the application of certain special economic measures in order to ensure the security of the Russian Federation"), the effect of a temporary ban applies only to Ukrainian goods, and does not limit shipments from third countries which are in transit through the territory of Ukraine to Kazakhstan.

In this regard, in relation to the importation of goods that result from third countries (Turkey, some countries of the European Union), procedure for import via the Belarusian part of the external border remains valid.

NCE RK "Atameken" urges all entrepreneurs to take the necessary measures to minimize the adverse effects on the activity of Kazakhstani business, taking into account the changes made in respect of transportation from Ukraine.
