Red light in public procurement?
LLP “CONDOR KZ” and a number of companies, which are not allowed to participate in public procurement, applied to the Chamber of entrepreneurs to protect their rights
LLP “CONDOR KZ” addressed to the Regional Chamber of Entrepreneurs with a request to protect its rights, which were violated during participation in public procurement.
LLP has filed an application for the lot "The reconstruction of an apartment building", the organizer of which is Department of construction, public transport and roads of the Akimat of Zhambyl region.
The businessman said that he was not allowed to participate in the competition on illegal grounds.
The pre-admission report included a number of comments, including the statement that the potential supplier was not qualified in terms of work experience.
At the same time, according to the businessman, the organizer didn’t list work experience in the tender documentation, hence the remark is groundless.
Therefore, all comments have been eliminated by the supplier, except for work experience (by the way, which the supplier has), as this requirement was not in the tender documentation.
However, despite of this, by the decision of the tender committee LLP “CONDOR KZ” and other five participants were not admitted due to inappropriate qualifying requirements and lack of experience. Only one supplier was allowed, which was invited to conclude a contract by the method through one source. Moreover, all five companies offered the lowest prices, and admitted one had the highest price.
Entrepreneurs Chamber of Experts sent an appeal to the competent authorities, today, verification of the legality of the competition has been the State Department of Internal Audit of Zhambyl region.
