There will be no double taxation
The issue of the legality of Russian documents, confirming residency, has been resolved
The Head of State signed the Law of Kazakhstan "On Ratification of the Agreement in the form of the procedure of exchange of notes on recognition of official documents confirming residency issued by the competent authorities of the Republic of Kazakhstan and the Russian Federation in the framework of the Convention between the Government of the Republic of Kazakhstan and the Russian Federation on avoidance of double taxation and prevention of tax evasion taxes on income and capital".
As you know, over the past four years, the Kazakh businessmen constantly faced with the refusal of the Russian tax authorities to take residence certificates, as they are missing an apostille. The Russian judicial authorities entrusted with the apostille function, referring to the Convention on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters concluded between the CIS member states (Minsk and Kishinev Convention), refused to put an apostille. To address this situation, NCE throughout this period has repeatedly appealed to the Ministry of Finance of the Republic of Kazakhstan and the Government of Kazakhstan.
After an exchange of notes, the issue will be finally settled and entrepreneurs will be able to apply the provisions of the bilateral Convention with Russia on avoidance of double taxation on the basis of the residency certificate from the Russian partners, without an apostille.
This Agreement will be extended retrospectively from 2011, in connection with which entrepreneurs in the course of the tax audit will not be assessed additional income tax that they have not previously been withheld at source of payment of income payments to Russian counterparts.
