Private bailiffs of Almaty violate the law
The director of LLP "TRANS-SERVIS" addressed to the National Chamber with a complaint about the illegal actions of the private judicial bailiff of the regional chamber of private judicial bailiffs (PJB) of Almaty.
From the materials of the appeal it follows that on the basis of the decision of the specialized inter-district economic court of the city of Almaty on securing the claim dated by May 17, 2016, PJB Uygun Ibraimov seized the movable and immovable property, including money for LLP "TRANS-SERVIS", which are on settlement accounts in second-tier banks within the size of the claim in the amount of 682,960 tenge.
However, the decision of the Almaty Economic Court canceled the decision dated by November 17, 2016, the arrests imposed by the decision of the Court on May 17, 2017, have been dropped.
By the decision of the Economic Court of Almaty city dated by January 17, 2017, which entered into legal force, the claim of SP "DVD Puts" on recovery of the amount of debts from the Partnership in the amount of 682,960 was refused.
Meanwhile, the statement of the Partnership on the removal of the above-mentioned arrests by private judicial bailiff Ibraimov is ignored, moreover, the latter requires the applicant to unjustified remuneration for the removal of arrests from the settlement accounts of second-tier banks.
The National Chamber of Entrepreneurs of the Republic of Kazakhstan "Atameken" conducted its investigation, as a result of the decision the arrest was withdrawn from the settlement accounts of the partnership existing in banking institutions.
