The National Chamber helped to remove the arrest from the auto of a businesswoman
The actions of the pre-judicial investigation body for retaining the entrepreneur's property were illegal
In July of this year, the National Chamber received an appeal from an individual entrepreneur Tatyana Polla on the issue of assistance in lifting the arrest of a car belonging to the applicant.
In 2011, an entrepreneur purchased a car on the territory of Kazakhstan, which at the time of purchase was registered in Kazakhstan. In 2013, with the sanction of the prosecutor's office, in connection with the institution of a criminal case, the department for combating smuggling of the Customs Control Department in Zhambyl region seized this car. The criminal case was dismissed in 2015, but the arrest was no lifted from the property.
The issue of confiscation of the arrested property in a criminal case into the income of the state can be resolved only by a court verdict. However, there was no such decision on the vehicle belonging to SP “Polle TV”, and therefore the actions of the pre-trial investigation body for keeping the property of the said person were illegal.
As a result of measures taken by the National Chamber, the issue was resolved positively.
According to the State Revenue Department of the Zhambyl region, the decision to cancel the arrest of a car was sent to the Traffic Police Department of the Internal Affairs Department of Zhambyl region.

Having really seen the result of applying to the Chamber for the protection of our rights, let me wish you and your team success", says a thank you letter of Tatyana Polle, addressed to the Chairman of the Presidium of NCE RK "Atameken" Timur Kulibayev.
