The hardest thing is to overcome bureaucratic obstacles
At the regular meeting of the Council on protection of the rights of entrepreneurs were considered appeals of entrepreneurs on the illegal actions of state officials
About obstacles created by the Department of land relations in Shymkent, when a state official not only violated the land laws, but also the constitutional rights of citizens, trying to protect their property, stated the Chamber of Entrepreneurs.
Experts spoke about the administrative barriers identified by the Chamber, which were created by local executive bodies.
"At 10 meetings of the Council during the past year, there were considered 33 appeals of entrepreneurs, 23 of which were resolved in favor of entrepreneurs themselves, and almost all of them were related to issues of land relations", - said the chairman of the Council for Protection of the Rights of Entrepreneurs of RCE of SKR Moldiyar Orazaliyev.
The appeal of a businesswoman Perizat Amanbaeva is one of thousands of similar stories in Shymkent, when an entrepreneur suffered by the fault of state officials, regulating land relations. With their light touch, it appeared that there were several owners of land plots. By the way, land disputes is one of the most common phenomena in the regional center of South Kazakhstan, where there are many individual housing construction facilities and land plots, which turned out have several owners. But the story of the ordeal, which the entrepreneur has experienced in search of truth, shocked members of the Council. One of the involuntary hostages of land plot scandal joined the majority, and the second landowner bypassed all conceivable relevant bodies, that for several years played fool with the entrepreneur, sending him from one organization to another. Confusion with land plots was caused by the department of land relations and land-cadastral branch of Sairam district of South Kazakhstan region. Deputy head of the department of land relations of Shymkent, who attended the meeting, volunteered to personally help the entrepreneur, who, incidentally, is not going to sue the heirs of the second owner of the land plot, and is even ready to assist.
The Council recommends the Chamber to conduct monitoring of the state services, rendered upon joining of Sairam district to Shymkent, as well as to send materials to a prosecutor’s office for their intervention.
In general, as it was noted by the Chairman of the Board, during the year of its activity, this body has fully justified its purpose and proved to be necessary. Often, at its meetings we find solutions to systemic problems (affecting a large number of entrepreneurs), and private issues worth hundreds of millions, and the difficulties of small business. An appeal of every entrepreneur entering, the Chamber, whether he is a sole proprietorship, a farmer or a representative of a large corporation, it is carefully studied. And legal incidents are considered (for example, the one associated with the Shymkent water park "Dolphin").
"The uniqueness of the Council that the entrepreneurs in this region have the opportunity to appeal directly to the officials, to ask them specific questions about their problem. In addition, all this is widely covered in the media, so any entrepreneur whose issue is considered by the Council can be sure that it will be widely spread. At the end of each Board meeting, the participants adopted resolutions on the basis of which the Chamber makes the appropriate steps for the protection of a businessman and addressing the systemic problems ", - said Moldiyar Orazaliyev. By the way, he emphasized that the most difficult it is to break through bureaucratic barriers. As it was shown, the officials often use their levers of power that the ordinary citizens can hardly resist.
