Any court hearing of an entrepreneur with the state body is a shock
The new joint customs and tax code will be developed with consideration of the proposals of NCE RK
Ombudsman on the protection of the rights of entrepreneurs of Kazakhstan Bolat Palymbetov during the reporting meeting with the entrepreneurs of the region told about what has been done and is being done to protect the rights and interests of entrepreneurs. "There are a lot of complaints from entrepreneurs about the fact that, if the tax authorities file a case to the court, almost always entrepreneurs lose cases. We have statistics, in which 99% of the loss is unambiguous, - said Bolat Palymbetov. - And for the entrepreneur any court hearing with the state body is a shock. Therefore, when developing a single customs and tax code, the working group includes experts of the National Chamber. The Working Group is developing a proposal, based on the presumption of innocence of an entrepreneur".
Deputy Chairman of the Board of NCE RK "Atameken" Rustam Zhursunov also spoke about already taken steps to change the tax legislation. "For example, we have raised the question about the pointlessness of an appeal to the authority, which controls it - said Rustam Zhursunov. - And in case of an address to a higher authority, an entrepreneur can write a power of attorney on our name, and we are going to defend his interests in Astana".
According to Deputy Chairman of the Board of NCE, the size of the state duty for entrepreneurs was limited, there were made proposals for the humanization of the administrative and criminal law. "Situation, in which an entrepreneur is obviously guilty, are unacceptable. At the suggestion of NCE, the new Entrepreneurial Code of RK includes principles of good faith and the presumption of innocence of an entrepreneur. For example, non of the 39 offenses in the sphere of business stipulated a warning in the Administrative Code. Therefore, we have formed a proposal for updating and humanization of the Administrative and Criminal Codes of the Republic of Kazakhstan ", - said Zhursunov.
Summing up the meeting, the Commissioner for the Protection of the rights of entrepreneurs Bolat Palymbetov stressed that "the officers of the National Chamber of Entrepreneurs of Kazakhstan actively defend the rights of entrepreneurs".
"Their work reveals many violations of the law. Entrepreneurs are not disturbed by unjustified inspections as before. Institute of Business Ombudsman appeared for the first time in Kazakhstan. The new structure has broad powers. And it should ensure stable growth of business activity ", - summed Bolat Palymbetov.
