"Atameken" – stands for clear procedures of development of RLAs in the EAEU
Council of the Eurasian Economic Commission approved the documents governing the decision-making procedures in the sphere of technical regulation within the EAEU
Technical regulation in the framework of the EAEU is carried out in accordance with the principles established by Article 51 of the EAEU Treaty. One of them is the establishment of uniform mandatory requirements in the technical regulations of the Union or national mandatory requirements in the legislation of the Member States only to the products included in the unified list of products for which mandatory requirements are established within the Union.
Member states of the EAEU do not allow the establishment of mandatory requirements in the national legislation for products not included in the single list.
Single list of products for which mandatory requirements are established in the framework of the EAEU, consists of 66 positions.
The Council of the Eurasian Economic Commission approved by the decision number 23 dated by March 17, 2016 the "Procedure for creation and maintenance of a single list of products in respect of which were set mandatory requirements within the framework of the Eurasian Economic Union" (published on April 29, 2016, shall come into force after 30 calendar days from the date of publication).
This Order establishes the grounds on which the products can be included or excluded from the single list.
The procedure also determines the format of preparation, submission and consideration of proposals for inclusion of products in a single list, proposals on exclusion of products from a single list, and proposals on amendment in the name (species, groups) of products included in the unified list.
In addition, within the framework of the EAEU was formed Advisory Committee for technical regulation, application of sanitary, veterinary and phytosanitary measures.
The Committee is an advisory body providing consultations with representatives of member states of the EAEU, representatives of the business community and development of proposals in the field of technical regulation, application of sanitary, veterinary and phytosanitary measures, on draft decisions of the Supreme Eurasian Economic Council and the Commission.
At the initiative of the Kazakh side for the full review and consideration of the views of all interested parties has been prepared a list of questions, on which the Collegium of the Eurasian Economic Commission is obliged to hold consultations within the Advisory Committee before taking a decision by the Collegium or the Board of the Eurasian Economic Commission.
The Council of the Eurasian Economic Commission by the order number 7 on March 17, 2016 approved "list of issues on which the Board of the Eurasian Economic Commission is obliged to consult the Consultative Committee on Technical Regulation, Application of Sanitary, Veterinary and Phytosanitary Measures before the adoption of the decision by the Collegium or the Board of the Eurasian Economic Commission" (published on April 29, 2016, shall come into force after 10 calendar days from the date of publication).
The adoption of these acts of the Commission is the result of great efforts of government officials and the business community of the Republic of Kazakhstan and is aimed at improving the legal framework of EAEU.
