Changes in copyright law should help business

At the Chamber of Entrepreneurs were held public hearings on amendments to the Copyright Draft Law

The Chamber of Entrepreneurs invited the Deputy Minister of Justice Elvira Azimova, representatives of the Ministry of Agriculture, the Ministry of Interior, the staff of the National Institute of Intellectual Property, as well as employees of scientific institutions, organizations for collective management of copyright and related rights, patent attorneys and business representatives to the public hearing of the draft law "On amendments and additions to some legislative acts of the Republic of Kazakhstan on improvement of legislation in the field of intellectual property".

The main purpose of the hearing – is to explain and to discuss the draft law, which presents interest to citizens and businesses. Changes in the law designed to provide a systematic transition to the standards of the Organization for Economic Cooperation Development in the sphere of protection of intellectual property.

"Kazakhstan has become a member of the EAEU and the WTO. Within these two organizations a lot of attention is paid to objects of intellectual property. Not only from the position of protection, but also as a subject, which should have free circulation on the market. We generally meet at the hearings people who are related not only to creation, but also the use of intellectual property. And the number of proposals is connected with the strengthening of the status of intellectual property on the market. On our part we have to ensure the competitiveness of Kazakhstan's intellectual property, and those that come along with the foreign investors. The Chamber of Entrepreneurs have repeatedly raised the issue of commercialization of technologies. While these issues are more relevant for the Ministry of Investment and Development, the Ministry of Education and Science. We understand that our legislation has a certain influence", - said Deputy Justice Minister Elvira Asimova.

Director of the Chamber of Entrepreneurs of Almaty Yuri Tleumuratov urged businessmen to pay attention to the regulations that are now being discussed. He noted that the discussion of draft laws in Almaty has become a good tradition. Megapolis today brings 30% of revenue to the budget of the Republic, provides 40% of foreign trade turnover. 60% of Almaty residents are employed in the sphere of small and medium-sized businesses.

The draft law provides for the introduction of 188 amendments in 12 legal acts of RK. These are the Civil Code, the Code of the Republic of Kazakhstan on tax payments, the Code of Administrative Offences, Entrepreneurial Code, copyright law and related rights, etc.

The main novels of the draft law are:

- The creation of a single-level system of registration intellectual property by delegating expert organization (RSE "National Institute of Intellectual Property") with the rights for registration of intellectual property;

- Possibility of pre-trial dispute review for disputes related to registration;

- Ensure the rights of copyright holders to receive compensation for the illegal use of the trademark;

- Publication of trademark applications from the time they are submitted to the expert organization.
