Who needs a re-certification?

A number of Kazakhstani technical and copyright experts can remain without attestation. This was stated today during a conference call organized by the Agency for Civil Service and Anti-Corruption and "Atameken" on the results of work in the field of architecture, town-planning and construction, said Deputy Chairman of the Board of NCE RK Rustam Zhursunov. He noted that today the issue of attestation of experts carrying out expert works and engineering services in the sphere of architectural, town-planning and construction activity is acute. "Earlier, the procedure for attesting experts was regulated by the Rules approved by the Decree of the Government of the Republic of Kazakhstan on 25th of January 2012, according to which a 5-year period for re-attestation of experts was established. At present, certification is carried out in accordance with the Rules for attestation of experts approved by the order of the Ministry of National Economy of the Republic of Kazakhstan on November 27, 2014 and put into effect in February 2015. The current rules do not provide for the re-certification procedure and do not regulate the time for re-certification. Thus, certificates issued after February 2015 are unlimited. In this case, the removal of the limitation period of the certificate of the expert excludes the obligation for re-certification and accordingly the Rules have a retroactive effect on previously issued certificates of experts", - said Rustam Zhursunov. At the same time, the current legislation does not provide for the renewal of certificates with the specified validity period for indefinite certificates. In connection with this, at present, the departments of state architecture and construction control of Aktyubinsk, Akmola, North Kazakhstan, Karaganda regions and the city of Astana refused certified experts in re-issuing certificates for indefinite period and stated that they need to undergo another . "In the opinion of these bodies, the provision of services by an unintended state standard will be a "hidden service ". At the same time, the remaining 11 regions conduct this procedure on the basis of an explanation from the Ministry of National Economy of the Republic of Kazakhstan", - noted the deputy chairman of NCE.

He stressed that according to the register of certified experts posted on the official Internet resource of the Ministry of National Economy of the Republic of Kazakhstan for the period from January 2012 to February 2015 in these regions, 2798 experts were certified, of which 1528 in the city of Astana. Another problem, in the opinion of the leadership of the National Council, is the inspections of the activities of persons carrying out technical supervision of the construction progress, conducted by the state architectural and construction control bodies. "According to the Entrepreneurship Code of the Republic of Kazakhstan, the requirements of paragraph 2 of Chapter 13 of the Entreprenerial Code are not applied to this type of control, thereby the verification of data is conducted by the authorized body without issuing an act on the appointment of verification and registration of the audit with the bodies of legal statistics and special accounts, which in turn creates conditions for commission of corruption offenses", - said Rustam Zhursunov.

He cited the example when, in the Kostanay region, experts of LLP Nadezhda-S received 9 notifications of technical inspection during the construction of facilities in Q4 2016, which does not allow the entrepreneur to fully fulfill his obligations and negatively affects the Entrepreneurial activity. "The National Chamber considers that the existence of conditions restricting entrepreneurial activity and contributing to the development of corruption is unacceptable. We believe it is necessary to conduct additional work in this direction, aimed at eliminating the causes of these conditions", he said. Rustam Zhursunov stressed that the architectural and construction sphere in our country is of great importance for the development of the country's economy and is one of the most extensive areas closely related to the activities of local executive bodies and a number of state control bodies. The work carried out jointly with the Agency to identify the causes and conditions conducive to the commission of corruption offenses shows that in this sphere the facts of embezzlement, bribery and abuse of official powers predominate both at the stage of preparation of permits and at the stage of construction.
