The main obstacle for entrepreneurs in procurement is "adjustment" of documentation by the customer for a particular supplier
In 2016, out of 8,000 technical specifications, violations were found almost in half
In his report at the enlarged meeting of the Faction of the party "Nur Otan" with the participation of NCE RK "Atameken" on the development of entrepreneurship in Kazakhstan, the Director of the Regional Chamber of Entrepreneurs of East Kazakhstan region Igor Shatsky dwelled on the problems of the domestic producer in the field of procurement, and the main obstacle he considers "the adjustment" of competitive documentation.
"Today, there are systemic problems that impede access of domestic producers to procurement. The main one is "compliance" of the customer of the tender documentation (technical specifications) for certain suppliers. This problem is known to everyone here, it has been for many years, and it remains, despite all the measures taken", - said Igor Shatsky.
In recent years there have been attempts to suppress violations with the help of new tools.
"The first thing that has been done is a preliminary discussion of the tender documents (technical specifications) of the goods, works and services to be procured. In 2016, at the initiative of potential suppliers, more than 3,800 of the 8,000 technical specifications were changed, i. e. violations were found almost in half of them. We believe that this indicates that the preliminary discussion is working, but it can’t completely eliminate the problem of "adjustment" of documentation for a particular supplier”, - explains Igor Shatsky.
The next step was, according to the speaker, the conduct of the internal state audit of cameral control directly on the public procurement portal.
"In 2016, 226 thousand purchases worth more than 4 trillion KZT were covered by cameral control (of them 223 thousand purchases in the amount of 4 trillion KZT were procured through tenders and price proposals). In the course of this work, violations of 43 thousand purchases were identified and eliminated in the amount of 463 billion KZT, 133 officials were brought to administrative responsibility for non-fulfillment and untimely execution of directed notifications on elimination of violations. At the same time, not all conducted procurements are covered by cameral control. We consider it is expedient to continue the application and improvement of these instruments", - added the speaker.
There is another mechanism that can be used to combat this, says the director of the regional chamber. It is about the right of customers to involve industry experts in the development of a technical specification (or technical task). At the same time, the attracted expert can’t be a participant (or an employee of a participant) of the conducted procurement in the future. In connection with this fact, this norm is not claimed by business.
"Undoubtedly, we are ready to improve the above three proposals, nevertheless, they all have a great influence of the human factor", - summed up Igor Shatsky.
