SELLERS ON THE MARKETS TO BE COMPENSATED FOR THE ONLINE CASH-REGISTER MACHINES' PURCHASE
The “Atameken” initiative related to reducing the tax liabilities for business is reflected in the draft law.
Starting from January 1, 2019, individual entrepreneurs operating via non-stationary retail facilities on the open marketplaces (except those who has a patent) will be required to use cash registers with data transmission services.
“Starting from 2019, businessmen trading on open marketplaces will have to use online cash registers, and in 2020 both the entrepreneurs who work in special tax regime based on a patent, and the peasant households, will be added to this list as well,” - Zhenys Zhanbulatova, the Director of the Tax Department of the NCE RK "Atameken", says.
Considering that the installation of cash registers is compulsory and entails additional financial expenditure for the small business, "Atameken" took the initiative to offset the costs of cash registers for entrepreneurs. The NCE's proposals are reflected in the draft law and come into force next year.
“At the moment, a bill is drafted, including the changes in the Revenue Code. These changes provide the reduction of tax liabilities by 50 %, but not more than 60,000 tenge for entrepreneurs working by special tax regime based on a patent and simplified declaration. This arrangement would be implied for 1 year period, starting from January 1, 2019,” - Zhenys Zhanbulatova says.
Meanwhile, on October 1, 2018, the list of activities, according to which the taxpayers of RK are obliged to use the online cash registers, was extended (from 10 items to 27). It includes car sales and light passenger vehicle sales, wholesale trade in beverages and pharmaceutical, clothing trade, pawnshops activities, real estate agencies, advertising agencies etc.
Remind that the proposal of entrepreneurs to use cash registers with data transmission services came from government agencies in 2014 as a part of the Tax Administration Reform Project.
Initially, introduction of these norms was to come in January 1, 2014. However, due to the virtual lack of technical capabilities, the NCE offered to postpone the date to July 1, 2014, and the final term was set on July 1, 2015.
Since January 1, 2016, the demands to use cash registers have been extended to entrepreneurs engaged in certain types of activities (up to January 2018, the list included 10 types of activities and was approved by the Government of the Republic of Kazakhstan on December 30, 2015, No. 1129). The requirements above were also transferred to the new Tax Code, which came into effect on January 1, 2018 (the list of activities was approved by order of the Minister of Finance of the Republic of Kazakhstan on February 16, 2018, No. 206).
According to the developers, the introduction of online cash registers helps to reduce the level of the "grey" economy and increase tax revenue on the one hand, on the other - it helps to reduce the risk level for the entrepreneur if Tax Administrations applies risk management frameworks and also to reduce the number of thematic inspections.
