Atameken advocated for IOSA safety standards

The Atameken NCE RK advocated for the acceptance of the IOSA safety certification requirements in the form of national regulations or aviation standards. However, the IOSA (IATA Operational Safety Audit) requirements do not replace, but complements, the supervision and control that is applied in Kazakhstan. 

Today, 27 December, a plane carrying almost 100 people has crashed near Almaty airport in Kazakhstan, killing our compatriots. The staff of the Atameken National Chamber of Entrepreneurs together with the whole country mourn for the victims of the crash of Bek Air aircraft. We sincerely wish a speedy recovery of those who have been injured in this disaster.

President of Kazakhstan Kassym-Zhomart Tokayev gave instructions to conduct a comprehensive investigation into the details of the disaster and set up a government commission to investigate the circumstances surrounding the tragedy.  While waiting for the results of the investigation, the  Atameken NCE RK, for its part, raised the entire chronology of events to understand the situation as deeply as possible.

BekAir, as a business entity, is a member of the Atameken National Chamber of Entrepreneurs. In 2015, the air carrier addressed the National Chamber with an issue on the Rules for allowing the airline to perform regular domestic commercial flights. 

The Chamber provided an official response to BekAir that the requirement to have an IOSA certificate (International Air Transport Association (IATA)) does not contradict the requirements of national legislation, i.e. is legal.

BekAir, as a member of the Atameken NCE RK and Subcommittee on Civil Aviation, brought the issue to the Subcommittee meeting held on January 12, 2016. The discussion was attended by business representatives of Air Astana, SCAT and Qazaq Air, as well as representatives of government agencies - the Committee on Civil Aviation, the Committee for Regulation of Natural Monopolies and Protection of Competition.

The Subcommittee did not discuss the abolition of IOSA certificate requirements, as it was about flight safety. The members of the Subcommittee and government agencies came to a consensus: to give a transitional period of 1 year to provide the certificate, namely up to 2017.

Moreover, the Subcommittee of the Atameken NCE RK recommended the Civil Aviation Committee to amend the law to apply IOSA audit standards in Kazakhstan. The Atameken NCE RK proposed to update IOSA requirements in the form of national rules or aviation standards in civil aviation, which would make them mandatory.

At present, however, the national legislation of Kazakhstan does not require an IOSA certificate. This is due to the position of the Committee for Regulation of Natural Monopolies and Protection of Competition of the RK: "The requirement is relevant for larger airlines. Taking into account the fact that for low-budget regional companies, which operate domestic flights at a lower cost, passing this audit creates certain difficulties, we believe that if these companies leave this segment, it will lead to market monopolization and increase in the cost of tariffs".

It is wrong to conclude the people responsible for the deaths until the circumstances of the tragedy are proven. Before the announcement of the results of the investigation, we must unite and help the families and friends of the victims of the plane crash.
