Atameken hosts extended meeting on issues of obtaining industrial certificates by organizations for disabled persons

The Atameken NCE RK has become a platform for an extended meeting on problems of issuing industrial certificates (hereinafter - IC) to manufacturers for disabled persons. The meeting has been held with the participation of the Chairman of the Board of the Atameken NCE RK Ablay Myrzakhmetov, representatives of the business community, including more than 100 representatives of organizations for disabled persons, as well as representatives of the Ministry of Finance, Labor and Social Protection of Population, the Committee for Technical Regulation and Metrology, Industrial Development and Industrial Safety, Samruk-Kazyna Fund, and others.

As a result of the analysis of appeals and complaints from organizations for disabled people about obtaining IC, the National Chamber discussed earlier at the meeting on improving the Rules of issuing IC on January 15, 2020, and then the Atameken NCE RK presented the main problematic issues at the meeting.

Thus, the representatives of associations raised the issue of the high cost of industry expertise, its cost can reach KZT 670,000 taking into account the payment for the flight, accommodation, and meals of experts.

In addition, the National Chamber noted that entrepreneurs, including organizations for disabled people, often complain about the lack of industry experts and delaying the process of examination.

Also, the Atameken NCE RK asked the Committee for Technical Regulation and Metrology of the Ministries of Trade and Integration of Kazakhstan to pay attention to the problem of lack of laboratories for testing furniture industry products in accordance with technical regulations to obtain a Certificate of Conformity.

The analysis of the National Chamber also showed that the problem of overstated requirements to organizations for disabled people developed by the Association of Furniture and Light Industry in excess of the basic criteria under the Rules for issuing IC is acute.

Thus, given the numerous complaints from organizations of the disabled, the Atameken NCE RK has brought the issue of the need to extend the issuance of IC to organizations of the disabled to a wide discussion.

During the discussion, all representatives of organizations for the disabled people expressed a position on the need for IC as the only tool to verify and support organizations for the disabled people, which are actual manufacturers of products, and to combat false manufacturers.

In this connection, the Atameken NCE RK initiated several proposals:

First, it is necessary to establish a requirement for at least one industry expert from the Associations in each region to conduct the expertise. According to the Chamber, this will solve the problem of shortage of industry experts, as well as eliminate the cost of flight, accommodation, and meals, thus reducing the final cost of the expertise.

Secondly, it is proposed to work out a mechanism for verification of organizations for disabled people. The lack of a single register of such organizations creates conditions for the establishment of false enterprises that can win industrial volumes in public procurement.

In turn, the Ministry of Labor and Social Protection of the Republic of Kazakhstan recognized the omission in this matter and expressed readiness to consider the proposal of the National Chamber and organizations for disabled people.

In addition, Almaz Yerzhan, Advisor to the Chairman of the Board of the Atameken NCE RK to protect the interests of persons with increased needs, also expressed the need to consolidate organizations for disabled people into a single association.

Remind that in connection with the adoption of amendments to the legislation on public procurement and procurement of subjects of the quasi-governmental sector regarding the admission of organizations for disabled people to participate in public procurement, after the verification by the Ministry of Finance (web portal of public procurement) for compliance with all conditions on the number and costs of labor (p. 11) of the first part of Art. 394 of the Tax Code) in February 2019, the Ministry of Labor and Social Protection of Population lost the function of forming the list of organizations for disabled people (Order of the Ministry of Health and Social Development of the Republic of Kazakhstan from 29.12.2015 #1065).

Third, the Atameken NCE RK has been proposed to consider in more detail, together with sectoral associations and organizations of the disabled, the sectoral criteria for obtaining IC. Participants of the meeting will return to this issue at the meeting of the Committee for the Development of Human Capital and Social Policy of Business Presidium of the Atameken NCE RK next week. After that, the proposed amendments to the Rules will be sent for approval to the Presidium of the Atameken National Chamber of Entrepreneurs, as defined in the Law "On the National Chamber of Entrepreneurs".

Fourthly, as it was previously discussed at the meeting on January 15, the Atameken NCE RK will automate business processes between the Chamber, Associations, industry experts and manufacturing enterprises in the mechanism of issuing IC. This measure is designed to ensure full transparency of processes at all stages of issuing IC. Also, it was decided to exclude the codification of products manufactured under the Unified nomenclature directory of goods, works and services system from IC due to excessive restrictions from participation in government and quasi-government purchases.

The Atameken NCE RK plans to keep the issues of obtaining IC for organizations for disabled people under control in the future.
