Systematic problems of business were discussed at the joint meeting of the Council for the Protection of the rights of entrepreneurs NCE RK "Atameken" and the Council for the protection of the rights of entrepreneurs RCE of Almaty
The agenda included acute challenges faced systematically by entrepreneurs of Almaty. In particular, the issue of the rental fee of communal property for catering organizations, there were received complaints from entrepreneurs on unjustified taxation of information sign boards, the unlawful actions of SCE "Tospa su", the department of architecture and urban planning, regional offices of the State Revenue Department of Almaty and other systemic violations in the sphere of economic activity.
One of the most acute problems is the increase of the rental price for canteens at schools and hospitals.
"The General Prosecutor's Office supported the Chamber's position that the order was illegal, and sent a letter to the developers of the law - the Ministry of National Economy - about the need to eliminate provisions of the law. Unfortunately, the Ministry of National Economy did not eliminate the identified violations, the order was still valid, the proposal of the General Prosecutor's Office was virtually ignored. This is pure blasphemy! "- Said the representative of NCE RK "Atameken" in the Senate of the Kazakh Parliament, Chairman of the Council for the Protection of the Rights of Entrepreneurs under NCE RK "Atameken" Gani Kasymov.
The following resolution was proposed on the issue of the lease of canteens: to recommend to the National Chamber to re-apply to the General Prosecutor's Office on making the act of prosecutorial response to the order of the Minister of National Economy # 212 dated by March 17, 2015.
The case of an individual entrepreneur Tulendieva is an egregious example of the violations of the rights of entrepreneurs, where for more than a year the Office of architecture and construction of the city of Almaty doesn’t issue architectural-planning assignment. The National Chamber of Entrepreneurs of Kazakhstan "Atameken" sent a letter to the National Anti-Corruption Bureau and the Ministry of Justice. As a result, the prosecutor's office of Almaty city Department of handed to the head of Architecture Sadyrbaev a letter with explanation of the law, and the court officer of the Department of Justice of Almaty sent to the Internal Affairs Department of Almaty an order on prosecution of Sadyrbaev.
The meeting also considered other issues of concern in the sphere of economic activity.
"In our country, prison sentences for certain economic offenses is comparable to the punishment for murder involving deprivation of liberty for a term of eight to fifteen years. For example, you can go to prison for a term of 7 to 10 years for pseudo-entrepreneurship, tax evasion of companies- from 6 to 10 years. State agencies in an attempt to replenish the budget are ready to paralyze the work of the enterprises, to arrest accounts of entrepreneurs. All this "justifies" the need to replenish the budget. We have prepared a number of proposals for the humanization of criminal and criminal procedural law and for economic crimes", - said Gani Kasymov.
As it was stated by the director of the Chamber of Entrepreneurs of Almaty Yuri Tleumuratov in his report on the work carried out within the line of business protection, the National Chamber of Entrepreneurs received more than 11,500 applications within the line of business protection, of which more than 900 applications were received by the Chamber of Entrepreneurs of Almaty. The greatest number of complaints is received by the Regional Chamber of Entrepreneurs of Almaty in the following areas: tax relations (20%); disputes between employers (14%); land issues, architecture, construction (10%); purchases (7%); licenses and permits (4%); financial sector (4%); trucks (3%), and others.
During the event, the Ombudsman for Protection of the Rights of Entrepreneurs of Kazakhstan Bolat Abylkasymovich Palymbetov, who was appointed to this post by the head of State on February 19, 2016, was also presented to entrepreneurs of the city.
"The interaction of business and government is one of the most important factors of sustainable development of the country, so the work on elimination of administrative barriers will be strengthened ", - said Bolat Palymbetov.
