ATAMEKEN PROPOSES TO INTENSIFY PUBLIC CONTROL

Relevant organizations will discipline entrepreneurs

Atameken the National Chamber of Entrepreneurs of the Republic of Kazakhstan conducted an analysis and developed proposals for the prevention of such incidents as fires in places of mass congestion, the situation with passenger traffic, the burning of a bus on the highway in Aktyubinsk region, the fall of elevators in residential complexes in Astana, cases of mass poisoning in places of public catering.

One of the main reasons for the occurrence of the above-mentioned cases is unfair business practices and non-compliance with security requirements.

Atameken NCE RK protects and supports conscientious, law-abiding entrepreneurs.

To minimize the violations by entrepreneurs, the National Chamber has proposed the following initiatives.

This means the strengthening of consumer protection societies. With a view to sustainable development of the country, we consider that it is necessary to create a system that equally ensures the interests of both the state and business, and society as whole, consumers in particular.

State control reduces, the number of inspections is reduced, but in order not to create a vacuum and an atmosphere of permissiveness of entrepreneurs, Atameken proposes to strengthen public control by developing the sphere of consumer's rights protection

For business, public control is preferable to state control, and the population will trust the results of public control more. In addition, such measures will help to increase the level of legal literacy of the population itself.

Relevant organizations will protect the interests of the population and will discipline entrepreneurs to comply with the law.

In order to bring qualified specialists into the sphere, at the initial stage of development, we consider it necessary to provide budgetary financing, the placement of state projects for the creation and support of consumer protection societies.

The next is the strengthening of requirements for entrepreneurs in the sectors that have the greatest risk of infringement and violation of the consumers' rights.

For example, the situation with bus fires and city bus transport services clearly showed the neecessity of major reforms in this area.

Atameken together with state bodies (MID, MIA, MNE) developed a Comprehensive program (road map) for the development of bus transport services. Within the framework of this program, the requirements and responsibilities for bus transport system are provided for.

Such novelties as electronic ticketing of passengers, detailing the responsibility of organizers and carriers of regular bus routes in a standard contract, gradual restriction of the operation of buses on non-scheduled long-distance and international traffic by the terms of their operation (over 25 from 2019 and over 12 years from 2025), the prohibition of registration of large class M3 buses

(with a total length of more than 10.5 m, the weight of which exceeds 5 tons) for individuals, the mandatory availability of license cards in each bus (with an indication of the state registration number of the bus and expiry date), which is issued on a vehicle of a carrier that has a license to carry out activities of non-scheduled traffic.

Currently, the program is at the stage of coordination with state authorities. Following the results of the agreement, the program will be submitted to the meeting of the Government of the Republic of Kazakhstan.

Similarly, there is a need to strengthen the requirements in the sphere of lifting mechanismes.

In general, the licensing of the installation and maintenance of elevators was canceled in 2012, before the establishment of Atameken National Chamber of Entrepreneurs RK. At the same time, licensing is not a "panacea" in this case, since it only limits access to the market.

The main reasons for the deterioration of the situation lie in the lack of proper supervision by authorized bodies, because of the conflict in the legislation between the Law of the Republic of Kazakhstan "On Civil Protection", which provides only control over the safe operation of elevators at housing and utilities infrastructure and the business code which provides only supervision. These circumstances did not allow state bodies to conduct inspections, while the relevant state bodies did not actively try to eliminate these contradictions.

In addition, the non-governmental standard SI-18-2017 "Lifts, escalators, stairlifts. Specifications, safety requirements for equipment, service and installation" (hereinafter referred to as NGS) operates in Kazakhstan. The NGS includes all requirements for elevator equipment and establishes requirements for enterprises servicing elevators.

But it is necessary to raise the status of the document to the National Standard, which will allow state bodies to check its compliance and apply it as a reference in legal acts. Currently, the application for the transfer of the NGS to National Standart is filed. The approximate time frame for the adoption of the National Standard is July 2018.

Subsequently, the normative legal acts of the LAB will provide for a norm on the neecessity to comply with the requirements of the National Standard when carrying out the installation and maintenance of elevators.

Finally, Atameken NCE RK proposes the creation of the National Rating System, for example, catering facilities, hotels, shopping centers, taxi companies, etc.

We believe that the process of the formation of the Kazakh business has come to an end and it is time to improve the quality of the goods and services provided through the creation of Kazakhstan brands recognized on the international market.

This purpose can be achieved through the principle of "healthy competition and competitiveness", which primarily allows improving the quality of goods, works and services provided.

The rating system should be the instrument - an independent evaluation and ranking of business entities according to the opinion of consumers, official financial statements for the purpose of optimizing business processes and establishing the principle of fair socio-economic relations in business on the local and global markets.

Thus, the rating system, based primarily on the opinion of consumers, will help to stimulate the business to improve the quality of goods, works and services, as well as the level of client-orientedness.

The bright international examples of ratings are the Michelin Red Guide in the field of catering, the star system of classification of hotels of the World Tourism Organization.

To stimulate and motivate entrepreneurs, the national rating system can be linked to the state control system - the higher in the rating, the fewer inspections.
