What do Pavlodar entrepreneurs expect from the Business Ombudsman?

The Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan Bolat Palymbetov discussed the state of the economy, industry and small business in the Pavlodar region

During the visit the Business Ombudsman met with the regional Akim and the prosecutor. They discussed topical issues of development and support of business, in particular small and medium-sized business, as well as problematic issues.

According to the approved schedule of visits to the regions, the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan Bolat Palymbetov arrived in Pavlodar region to review the problematic issues of entrepreneurs in the region, to discuss the position of the region in the ranking "Business Climate", the level of corruption and the shadow economy.

It is worth noting that the Business Ombudsman – represents a completely new institute for the country. His high status and extensive powers allow to solve much more effectively the systemic problems of Kazakhstan's business and legislative conflicts.

In the afternoon, Bolat Palymbetov met at the round table with regional entrepreneurs and personally listened to every pressing problem.

Most often entrepreneurs complain about the decisions and actions of the tax authorities, on the sphere of procurement, land relations, as well as the actions of monopolists.

In addition, the Regional Chamber of Entrepreneurs noted that the recent increase in complaints on notifications on additional taxes, which are sent by the State Revenue Department, due to the recognition of the registration of legal entities invalid by the court, with which entrepreneurs previously had transactions.

The problem is that entrepreneurs learn about judicial decisions only from the tax authorities and they can’t appeal, because the courts refuse it on the grounds that they are not parties of those cases.

Businessmen can’t cancel tax notifications, as they are based on the original court decision. It is a vicious circle, in which bona fide entrepreneurs can’t exercise their constitutional right for judicial protection and prove their rightness in the court.

In 2015 the Regional Chamber of Entrepreneurs received 142 appeals. For 6 months of this year, it has already received 350.

The Regional Chamber resolved during this period 59 problematic issues in favor of entrepreneurs. The economic effect amounted to about 630 million tenge.
