"Baiterek" introduced for consideration of NCE the rules for review of housing projects
These rules came for the consideration of NCE from the operator of the construction of rental and credit housing JSC "Baiterek Development"
As it is known, on 23rd of December 2016 the Government of Kazakhstan approved the program "Nurly Zhol", effective implementation of the provisions which require the participation of public institutions in order to ensure transparency of procedures and decisions of the operators, about which spoke the deputy Chairman of the Board of "Baiterek Development" A. Userbaev on 12th of December 2016 at a meeting of the party "Nur Otan".
Anti-Corruption Strategy of the Republic of Kazakhstan for 2015-2025 years, which was approved by the Decree of the President of the Republic of Kazakhstan dated by 26th of December 2014 # 986, clause 3.2., enshrines the basic tasks of the Strategy:
- The introduction of the institute of public control;
- Combating corruption in the quasi-public and private sector.
Clause 4.3. of the Strategy also expressly provides that "the National Chamber of entrepreneurs along with the protection of interests of domestic business, should bear its share of responsibility for its transparency and integrity and take anti-corruption measures in the corporate sector".
Presented Rules contain the following main provisions:
- basic requirements for the projects (a total area of one apartment, requirements for final finish, the requirements for the right to land, the presence of project design documentation with a positive expertise, etc.);
- procedure for acceptance of applications (publication on the official website of the Company, an exhaustive list of documents, attached to the application, etc.);
- consideration of projects (legal expertise, technical expertise, security expertise, examination of risks, etc.);
- grounds for terminating the project review (restriction of business, liquidation, the presence of criminal cases and the like);
- procedure for making decisions only through a special commission (types of decisions);
- basic conditions of the agreement on investment in construction of the facility.
Annexes to the regulations set out the form a letter of application and a list of attached documents.
Representatives of NCE will be included in the composition of the Commission, as independent observers.
