On 31st of May this year. On the site of NCE RK "Atameken", the Department of Economic Integration (hereinafter - DEI) held a round table on the topic: "Common quarantine phytosanitary requirements of the Eurasian Economic Union: consultations and explanations". The representative of the Department of Sanitary, Phytosanitary and Veterinary Measures of the Eurasian Economic Commission Oleg Neborakov and the leadership of the State Inspection Committee in the agrarian and industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan (hereinafter referred to as the Committee), who were directly involved in the development of these documents, took part in it.
During the round table, the commission's representative Oleg Neborakov, representatives of the domestic business in the field of agriculture, presented key features of the newly adopted documents of the Eurasian Economic Union (hereinafter - the EAEU, the Union).
Participants of the Round Table, representing business, quite actively expressed their interest in a more detailed and in-depth understanding of the new "rules of the game on the big arena". A number of questions were raised aimed at highlighting the control features with respect to common and rare quarantine facilities, both in Kazakhstan and the whole of the EAEU, in accordance with the accepted RLAs and the readiness of the Kazakhstan laboratory and diagnostic base for conducting the required studies.
The Commission's employee and representatives of the Ministry of Agriculture of the Republic of Kazakhstan provided comprehensive answers to the questions posed, which are of greatest interest to the Kazakhstani agricultural business in the hall and the ones, who participated in the videoconference mode from the regions.
"The Commission and authorized state bodies of the parties are interested in the maximum elaboration of the adopted documents, analysis by practicing producers and carriers of the Union's crop production, in order to identify possible complexities and acute angles. Such explanatory work with the Commission's participation has already been carried out in the Kyrgyz Republic, dates have been set for the Republic of Armenia and the Russian Federation, details of explanations are being elaborated in the Republic of Belarus. The Department of Sanitary, Phytosanitary and Veterinary Measures is always ready to cooperate in the supervised areas", - Oleg Neborakov said at the end of the meeting.
DEI of NCE RK "Atameken", in turn, notes the effectiveness of the practice of conducting similar activities aimed at clarifying the specifics of the regulatory framework of the Union on a regular basis, involving the maximum range of domestic producers.

On 11th of November 2016, during the meeting of the Council of the Eurasian Economic Commission (hereinafter referred to as the Council) were adopted the Single Quarantine Phytosanitary Requirements of the Eurasian Economic Union (hereinafter referred to as the Uniform Requirements), the Unified List of Quarantine Facilities of the Eurasian Economic Union (hereinafter - the List) and the Uniform Rules and Norms of Provision Plant quarantine in the customs territory.
The development and approval of these documents are stipulated in the framework of Article 59 of the Treaty on the Eurasian Economic Union (hereinafter referred to as the "Agreement") and the Decision of the Commission of the Customs Union dated by 18th of June 2010 No. 318 "On Ensuring Plant Quarantine in the Eurasian Economic Union".
The main objective of the adoption of the Uniform Requirements is to establish uniform quarantine phytosanitary requirements throughout the Eurasian Economic Union (hereinafter - the EAEC, the Union) and, accordingly, to ensure quarantine phytosanitary security against the penetration and spread of quarantine objects on it.
In this regard, DEI announces that since July 1 this year. (From the date of entry into force of the Decision of the Council "On Amending the Single Commodity Nomenclature for Foreign Economic Activity of the Eurasian Economic Union and the Unified Customs Tariff of the Eurasian Economic Union", but not earlier than July 1, 2017) uniform requirements are imposed on all quarantineable products (quarantined goods, materials, Goods) subject to phytosanitary control, and to quarantine facilities (pests, plants, etc.), including:
- Seed and planting material of plants;
- Vegetables and potatoes;
- Grain, seeds of leguminous and oilseeds and products of their processing;
- Fruits and berries;
- Cut flowers and buds, suitable for making bouquets or for decorative purposes;
- Timber;
- Other quarantine products;
Enterprises engaged in the processing of grain and its processing products using technologies that ensure the removal of seeds and fruits of quarantine weed plants viability;
The enterprises which are carrying out disinfection and marking of wood packing material.
According to the Unified Requirements, quarantine products of high phytosanitary risk when imported into the territory of the Union or moved within the framework of the EAEU must be accompanied by a phytosanitary certificate issued by the authorized body of the exporting country, in the column "additional information" which should indicate that the produce is produced in a zone free from quarantine objects (included in the List), and in case of their detection, the products must be processed, disinfected, returned or destroyed (including packaging).
At the same time, it should be noted that quarantine products of low phytosanitary risk (dried mushrooms, bamboo stalks, etc.) can be imported into the territory of the EAEU and moved along it without being accompanied by a phytosanitary certificate.
At the same time, high-risk quarantine products (including flowers) transported in carry-on baggage, baggage of passengers, drivers and crews of ships, aircraft, passenger cars and vehicles are allowed to be imported and moved to the Union without a phytosanitary certificate, provided that the cargo does not exceed 5 kg or 3 bouquets.
An exception for hand luggage is seed and planting material (including seed and ware potatoes and material for breeding and research purposes) which, when transported within the Union in luggage, hand luggage, must necessarily be accompanied by a phytosanitary certificate.
It is also forbidden to take out quarantine products outside the vehicles intended for food purposes and crews of these vehicles. In case of detection of contaminated products, it must also be decontaminated, destroyed, or sealed in special storage facilities for the period of the vehicle's stay on the territory of the Union.
Along with the foregoing, scientific institutions for the permission of the authorized body of the EAEU member state in terms of territorial competence can import living quarantine objects (regardless of the List) for research purposes.
The list, in turn, is a classifier of quarantine pests that are absent or limited in the territory of the Union and subdivided into insects, mites, nematodes, fungi, bacteria, phytoplasma, shearing, etc.
At the same time, the procedure for issuing a phytosanitary certificate in the Republic of Kazakhstan does not change significantly and still has the status of a public service, accordingly it is carried out in accordance with the approved standard.
The service is rendered by the territorial inspectorates of the State Inspection Committee in the agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan (hereinafter referred to as the "Service Provider") of the city, regional and district level (the addresses of the locations of the public service are posted on the Internet resource of the Ministry of Agriculture - www.minagri.gov.kz (in the section " Support and services ", subsection" Services in the field of crop production ").
The application is submitted to the address of the service provider (the office of the territorial inspection) or through the web portal of "electronic government" www.egov.kz (further - portal).
For the application and subsequent receipt of the phytosanitary certificate, the following list of documents is required:
To the service provider:
1) application form;
2) an identity document and a document confirming the credentials of the representative (for identification of the person);
3) requirements in the field of quarantine of plants of the national plant quarantine service of the importing country (compliance is checked by the inspector);
On the portal:
1) an application in the form of an electronic document;
2) the requirement in the field of plant quarantine of the national plant quarantine service of the importing country in the form of an electronic document.
After submitting the application, the responsible inspector notifies the applicant (if he / she applies for the inspection) or receives a notification to the User's Personal Cabinet (when filed through the portal) about the time for the applicant to submit quarantineable products for inspection, in order to establish the phytosanitary status of quarantineable products, if necessary, in the presence of the applicant (in the case of export of quarantine products from quarantine zones, the samples are sent for phytosanitary examination). As a result of inspection, an act of quarantine phytosanitary control and surveillance is issued, on the basis of which a quarantine certificate is issued.
More detailed information on the terms of the provision of public services, the forms of applications, the addresses of the places of supply, the grounds for refusing to provide government services, the procedure for appealing, etc. is provided in the standard of the state service "Issue of phytosanitary certificate for export of quarantine products outside the Republic of Kazakhstan", approved by order of the Minister of Agriculture of the Republic of Kazakhstan on May 29, 2015 No. 4-4 / 500 "On the approval of standards of public services in the field of plant quarantine".
Also, in accordance with the Regulations on the Procedure for the Implementation of Quarantine Phytosanitary Control (Supervision) at the Customs Border of the Customs Union (as amended by the decision of the Council of the Eurasian Economic Commission No. 50 of August 16, 2013) upon arrival at the destination point, officials of the authorized bodies of the importing Party, on the territory of which the place of arrival or place of delivery of quarantine products is located, carry out quarantine phytosanitary control (supervision) and withdraw the original phytosanitary certificate of the exporting country.

- in the Republic of Kazakhstan a fine in the amount of twenty to one hundred monthly calculation indices with confiscation of quarantineable products in case of impossibility of its disinfection and processing is applied;
- in the Russian Federation the imposition of an administrative fine on citizens in the amount of three hundred to five hundred rubles, on officials - from five hundred to one thousand rubles, on legal entities - from five thousand to ten thousand rubles;
- in the Republic of Belarus - a fine in the amount of ten to thirty basic units, for an individual entrepreneur - from thirty to sixty basic units.
