The National Chamber of Entrepreneurs "Atameken" held a press conference on the case of the head of LLP "Santechprom" Vladimir Kryuchkov.
"We want to appeal to the Commissioner for Human Rights, who has to protect the legitimate rights and interests of citizens of our country and Vladimir Kryuchkov is one of them. We hope that thanks to the human rights and civil society organizations, legal services and professional experts will be able to restore justice and to achieve the objective investigation of the case", - said Deputy Chairman of NCE RK "Atameken" Gulnar Kurbanbaeva.
Lawyers of NCE, after having studied all the evidences of Vladimir Kryuchkov found them reasonable.
"Judging by the procedural documents presented by Kryuchkov, the prosecution authorities violated the requirements of the law to clarify the circumstances justifying the suspect in the case, as well as mitigating the responsibility and punishment. As a consequence, the petition of the suspect and his lawyer on the conduction of investigative actions for the fullness of pre-trial investigation and establishment of objectivity and truth of the case was rejected", - stated the director of the department of legal protection of entrepreneurs NCE RK Oleg Savelenko.
In addition, according to the expert, the arrest on the property of LLP "Santechprom", founder and general director is Kryuchkov, was imposed illegally.
"This property belongs to LLP" Santechprom" as a legal entity, which cannot be responsible for the actions of Vladimir Kryuchkov as the founder and CEO", - he explained.
"I guess it's more convenient in this situation: to find the guilty, who will take the blame. Who should be to blame? Those who are most successfully use natural resources, who by coincidence were there during the disaster.
Who benefits it? I think it is easy to guess. Why is it done? This negligence and incompetence of the representatives of the investigation authorities, when there are such procedural violations, or it's still early, premeditated tactic of law enforcement, supervisory and other government agencies - a blind eye to the situation? Any person who has financial resources and can make up for the costs of population, there are people who are there and in this case you can bring them to justice", - said Kurbanbaeva.
According to the lawyer Nickolay Malyushenko, hydraulic engineering expertise, which formed the basis for the conclusion of the criminal case was conducted by experts from Taraz. "One can see that the statement was prepared by amateurs, who have never made such conclusions. According to professionals there are significant contradictions in the calculations", - he added.
"The objective of any investigation is to find out all the circumstances of the case, punish those responsible and prevent the repetition of the situation. In this case, all of this was not done. The investigation sees only one reason - breakthrough of the dam, and absolutely does not want to see the obvious - the abnormal flooding, which nobody could prevent. Also, the investigation has not pleaded guilty persons, whose competence is to control operation of the dam, which, by the way, due to the expiration of operation, repeatedly recognized as satisfactory", - said, in turn, a lawyer Oleg Kalugin.
Answering journalists' questions, what punishment threatens Vladimir Kryuchkov, the lawyer said that if not to intervene in this process now and the investigation will not objective, the entrepreneur may lose liberty for imprisoned for 7 years. Moreover, he will have to pay 1 billion 380 million tenge for damage.
