Atameken ready to draft new Concept of Entrepreneurship Development for 5 years

The Atameken National Chamber of Entrepreneurs proposes to develop a new Concept of Entrepreneurship Development for the next five years.  Eldar Zhumagaziyev, First Deputy Chairman of the Board, announced the key theses concerning the legislative measures to improve the business climate in Kazakhstan during the Government meeting.

Atameken is constantly working to identify and solve systemic problems of business.

All identified business problems are posted in the public domain on our website - in the Register of problems.

In total, during the existence of the National Chamber of Commerce, we have identified 624 problems, 501 of them or 80% were solved.

According to the results of the study of systemic problems of business, we have identified the most pressing issues and proposed more than 50 amendments aimed at improving the business climate in the country. The key problems are in the spheres of land relations, competition, economic and banking activities.

Also, we propose to make a number of amendments requiring amendments to the antimonopoly legislation, to the Entrepreneurial Code, to the laws "On the National Chamber of Entrepreneurs of the Republic of Kazakhstan" and "On State Regulation of the Development of Agro-Industrial Complex and Rural Areas", and "On Post".

Proposed amendments will:

- prevent the growth of fines for certain types of violations and the possibility to accuse business entities of violations of the antimonopoly legislation without collecting any evidence;

- improve land legal relations;

- create favorable legal, economic and social conditions for the implementation of business initiative.

In this regard, we ask you to support the amendments of the National Chamber within the 8th package of legislative initiatives.

Concept of Entrepreneurship Development for 2021-2025

This year, the Concept of State Regulation of Entrepreneurial Activities until 2020 is expiring, and all last reforms of the state regulation of business have been implemented.

Despite the ongoing systematic work aimed at developing state regulation of entrepreneurial activity in the country, the following problems still exist:

1) The formal and biased approach of government agencies to the regulatory impact analysis under a predetermined result, violation of the analysis procedures;

2) Allowance of excessive control load by some control authorities and maintenance of punitive nature of inspections;

3) prevalence of information requirements for a greater number of business entities despite the fact that they are less prohibitive for specific business entities;

4) underdevelopment of the sphere of self-regulation despite the existence of legally established norms.

At present, we can state that the Concept has not been sufficiently implemented.

In this regard, it is proposed to develop a new Concept of Entrepreneurship Development for the next five years. Thus, tasks of the new Concept should not be limited only to regulating issues, it is also necessary to include issues of development and support of businessmen.

The National Chamber is ready to develop a draft of the new Concept with concrete practical measures based on the real needs of domestic business.

The Authorized Body on Entrepreneurship represented by the Ministry of National Economy is requested to provide assistance in the work on the approval of the document at the level of the Government of the Republic of Kazakhstan.

Single Day of Report of enforcement authorities to the business community

In the implementation of the instruction of the President of the Republic of Kazakhstan Kassym-Jomart Tokayev on May 24, 2019, at the meeting of the Council of National Investors for the first time on September 30, 2019, in all regions was held a single day of report of regulatory authorities to the business community.

At the same time, at the reporting meetings, the government agencies just present statistics. Norms of legislation, preventive measures, frequently occurring violations and measures to prevent them were not explained. The regional chambers of entrepreneurs were poorly involved in the process.

In this regard, the National Chamber suggests the following:

1. to implement the Single Day of Report in the regional centers and cities of regional significance to fully cover and take into account problematic issues, and hold it at least two weeks before the Single Day of Report in regions, cities of national significance and the capital;

2. to change the emphasis from providing statistical reporting in figures to advocacy work on improvement of legislation;

3. to introduce the practice of mandatory posting on the website of the local executive body the reports of the state bodies on the control activities no less than a week before the Single Day of the Report.
